최근 기술 융합 시대에 신기술과 상상이 결합하여 다양한 작품이 창작되고 있다. 본 연구의 목적은 메타버스 가상공간 및 생성형 AI를 활용한 창작 관련 지식재산권 보호의 한계와 쟁점을 검토하고 현실에 부합하는 지식재산 보호 방향을 제언하 는 것이다. 최근 7년 간 한국과 미국, 영국 매체에서 비중 있게 보도가 된 사건 40여 가지 사례를 검토하였다. 또한 최근 메타버스 가상 갤러리 전시 현장과 생성형 AI를 활용한 작품을 조사하였다. 연구 결과, 메타버스의 경우 저작권, 상표권, 디자인권, 부정경쟁행위에 관한 쟁점이 많았고, AI의 경우 AI 창작물의 저작물성, 저작권 귀속, AI학습 데이터 저작권 침해 문제 등 주로 저작권과 관련한 쟁점과 의견이 분분한 논의가 많았다. 결론적으로 다섯 가지 제언을 도출하였다. 첫째, 지식 재산권을 기반으로 윤리적인 기준으로 협력하는, 표준화된 계약 모델이 필요하다. 둘째, AI 아트 데이터 뱅크(저장소) 생성 이다. 셋째, AI 미술품 경매의 투명성이다. 넷째, 국내 아티스트들과 디자이너들 대상으로 지식재산권 관련 교육을 진행해 야 한다. 마지막으로, 커뮤니티 중심 감독이다. 결국, 예술과 생성형 인공지능 기술, 메타버스 산업이 복잡다단한 양상으로 융합된 환경 속 분쟁을 해결할 수 있는 단일 솔루션은 없다. 학계 및 연구재단, 문화재단, 비영리 및 영리, 법조계, 예술계, 산업계의 의견이 골고루 반영하여 함께 노력할 필요가 있다.
In the recent era of technological convergence, various works are being created by combining new technologies and imagination. This paper aims to review the limitations and issues of intellectual property protection related to creation using Metaverse virtual space and generative AI and to suggest directions for improving intellectual property protection in line with reality. Over the past seven years, we reviewed 40 related cases heavily reported in Korean, American, and British media. In addition, we investigated the recent Metaverse virtual gallery exhibition site and works using generative AI. As a result of the study, in the case of Metaverse, there were many issues related to copyright, trademark rights, design rights, and the Unfair Competition Prevention Act. In the case of AI, there were mainly copyright-related issues and opinions divided, such as the authorship of AI creations, copyright attribution, and copyright infringement of AI learning data. There was a lot of discussion. In conclusion, five recommendations were drawn. First, we need a standardized contract model that cooperates with ethical standards based on intellectual property rights. Second, the creation of an AI art data bank (repository). Third, transparency of AI art auctions. Fourth, intellectual property education must be provided to artists and designers in Korea. Lastly, it is a community-oriented director. In the end, no single solution can resolve disputes in an environment where art, generative artificial intelligence technology, and the metaverse industry are fused in complex ways. There is a need to work together to reflect the opinions of academia, research foundations, cultural foundations, non-profits and for-profits, the legal community, the arts, and industry.
