선거구 획정은 정치적 대립과 타협의 산물이면서 동시에 국토 공간의 변동에 조응하는 기술적 영역에 속한다. 제헌의회 선거 이후 다양한 정치적 변화와 실험이 이루어졌고 이에 따라 선거구는 지속적으로 변화해왔다. 그러나 선거제도의 변화와 급속한 인구의 이동 속에서 선거구 획정의 원칙과 원리에 대한 진지한 논의대신 선거구의 기술적 조정만이 이루어졌고, 1995년의 헌법재판소 판결 이후에는 인구비례의 원칙이 선거구 획정의 가장 중요한 기준이 되었다. 본 연구는 제헌의회부터 21대까지 역대 국회의원선거를 분석하여 인구비례성의 변화를 추적하였다. 인구비례성은 제헌의회 이후 꾸준하게 악화되었다가 헌법재판소 판결 이후 개선되는 추이를 보인다. 그러나 시·도 공간단위에서는 이러한 인구비례의 원칙이 여전히 지켜지지 않고 있으며, 그마저도 인구기준을 맞추기 위한 비정상적인 선거구 조정이 지속되고 있다. 시·도 단위의 인구비례성 개선과 예측가능한 선거구 획정을 위해서는 인구비례성과 지역대표성을 절충할 수 있는 기술적 고려와 함께 총 의석수 결정, 시·도 단위 의석할당, 선거구획정 기구의 실질적 독립 등의 법적인 보완이 필요하다.
Establishing electoral districts is a product of political competition and compromise, and is also a technical task to represent the spatial changes in a country. Since the constitutional assembly of 1948, various political changes and reforms have been carried out, which led to the incessant changes of the electoral districts. Unfortunately, however, there have been only technical redistricting and redrawing without serious discussions on the rule and principle of establishing electoral districts under the changes of election system and mass population mobility. In the absence of political-philosophical discussions, the rules about equal population have been the most important principle since the decision of the constitutional court in 1995. This study examines the accomplishment of equality population principle in previous parliamentary elections from the constitutional assembly to the most recent 21st election. The declining trend of the equality indices rebounded after the decision of the constitutional court in 1995. However, the equality rules are not guaranteed at the larger metropolitan scale of si and do. Moreover, the inconsistent and aberrant redrawing of electoral districts has continued to meet the equal population criteria. To improve the level of population equality at si and do scale and to anticipate predictable and sustainable redistricting it is needed to have a discussion on population equality and regional representation, which would lead to the technical solution to compromise the two confronting values. Also, it is necessary to establish the rules about the decision on the total number of seats, apportionment at si and do scale, and the substantial independence of the redistricting commission.
