반려동물의 양적 증가와 이를 둘러싼 인식의 변화 속에서 반려동물의 보호·복지를 요청하는 목소리가 커지고 있다. 이러한 상황에서 동물보호법은 ‘동물이 질병으로부터 자유로워지도록 할 것’을 동물보호의 기본원칙 중 하나로 삼고, 반려동물의 질병 등에 적절한 조치를 게을리하는 행위를 동물학대로 규정하고 있다. 따라서 반려동물 양육인은 동물에게 질병이 생기면 신속하게 수의학적 처지를 제공할 필요가 있다. 이 점에서 반려동물 진료비는 반려동물 양육 가구에 의무적으로 발생하는 것이라 할 수 있다. 그런데 최근 의료체계의 고도화와 그에 따른 반려동물의 장수화·고령화가 맞물리면서 반려동물 진료비 부담 완화가 중요한 사회적 이슈로 떠오르고 있다.
현행 수의사법이 과잉진료행위처럼 반려동물 진료비 부담을 증가시킬 수 있는 행위를 금지하고는 있지만, 원칙적으로 사적 자치·시장경제 원리에 맡겨진 반려동물 진료 분야를 통제하는 데는 한계가 있다. 그러다 보니 반려동물 진료비가 동물의료기관마다 큰 차이를 보이는 등 반려동물 양육인으로서는 이해하기 어려운 부분들이 만연하고 있다. 이러한 배경으로 반려동물 진료비 부담을 완화하는 제도적 장치의 필요성이 지적되는 한편, 제도적 장치의 미흡을 보완하는 수단으로서 반려동물 보험이 주목을 받고 있다.
이 글에서는 직접적으로 반려동물 진료비 부담을 완화하는 제도적 장치를 검토하지 않고, 최근에 그 관심도가 높아지고 있는 반려동물 보험의 활성화·실효성 확보라는 관점에서 필요한 입법 과제를 검토하였다. 이는 진료비 부담을 완화하는 실효적인 제도적 장치, 예컨대 표준수가제 등에는 상당한 노력과 시간이 필요하므로 단기적 관점에서 그 활용을 기대하기 어렵다는 점을 고려한 것이다.Amid the quantitative increase in Companion Animals and changes in perception surrounding them, there are growing calls for the protection and welfare of Companion Animals. In this situation, the Animal Protection Act stipulates that “an animal should be free from disease” is one of the basic principles of animal protection. It is also stipulated that neglecting proper measures against diseases of animals is animal abuse. Therefore, Companion Animal-rearing households need to quickly provide veterinary care when an animal has a disease. In this regard, animal care costs are mandatory for Companion Animal-rearing households. Recently, the upgrading of the medical system and the resulting longevity and aging of Companion Animals are underway. As a result, easing the burden of Companion Animal care costs is emerging as an important social issue.
The current veterinary law prohibits acts that can increase the burden of Companion Animal care, such as excessive care. In principle, however, there is a limit to controlling the Companion Animal medical sector, which is left to private autonomy and market economy principles. As a result, there are many things that are difficult for Companion Animal-rearing household to understand, such as the cost of Companion Animal treatment varies greatly from animal hospital to animal hospital. Against this backdrop, the need for institutional devices to ease the burden of Companion Animal care costs is pointed out, while Companion Animal insurance is drawing attention as a means to compensate for the lack of institutional devices.
This article did not directly review institutional devices to ease the burden of Companion Animal care costs, but reviewed necessary legislative tasks in terms of ensuring the activation and effectiveness of Companion Animal insurance, which has recently been increasing its interest.
