대법원판결은 부작위에 의한 기망행위 성립에 법률상 고지의무를 요구한다. 또한 대법원판결은 부작위라고 명시하지 않은 채 고지의무 위반을 기망행위로 보기도 한다. 양자 모두 ‘고지의무’를 언급한다. 후자의 경우에도 대법원판결이 부작위에 의한 기망행위를 인정한 것으로 보는 견해가 있다. 전자의 경우와 마찬가지로 고지의무를 보증인지위의 발생근거로 보는 것이다. 그런데 대법원판결은 사실대로 고지 받았다면 거래하지 않았을 것이라는 가정적 관계로부터 신의칙상 고지의무를 인정한다. 그러한 의미의 고지의무는 기망행위의 개념 자체로부터 도출된다. 부작위에 의한 기망행위에서뿐만 아니라 작위에 의한 기망행위에서도 인정될 수 있다. 따라서 고지의무의 존재를 인정한 것만으로 대법원판결이 부작위에 의한 기망행위임을 전제로 하였다고 보기 어렵다. 부작위에 의한 기망행위에 해당하려면 부진정부작위범의 성립요건을 모두 갖추어야 한다. 그 핵심은 상대방이 행위자와 관련 없이 착오에 빠져 있어야 한다는 점이다. 그래야 소극적으로 그 착오를 제거하지 않은 것이 사회적으로 중요성을 띠는 부작위로 평가될 수 있다. 이 점에서 적극적으로 상대방의 착오를 유발해야 하는 작위에 의한 기망행위와 대비된다. 한편 적극적으로 상대방에게 그릇된 인식을 심으려면 동시에 소극적으로 아는 사실을 묵비하게 된다. 작위적 측면과 부작위적 측면이 혼재되게 마련이다. 작위·부작위 간 구별기준에 관한 대법원판결의 태도를 일관성 있게 적용하여 우선 작위에 해당하는지 검토해보고 보충적으로 부작위에 해당하는지 검토해 보아야 할 것이다.This study focuses on the decisions of The Supreme Court of Korea on the defrauding by act and omission.
Article 18(Crime Committed through Omission) of the Criminal Act provides that “When a person who, having a duty to prevent the occurrence of danger, or having caused the occurrence of danger, does not prevent the occurrence of danger, that person shall be punished in accordance with the results of such danger.”
The Supreme Court holds the opinion that the defrauding committed by an omission shall be regarded as equal to one committed by an action before the criminal law and thus regarded as the commission of fraud on the conditions that ⓐ a party who failed to act should have a legal duty to notify anticipated under the good faith principle to prevent infringement of legal interests of the other party and ⓑ it should fall into an error without the intervention of the party who failed to act.
Also the Supreme Court holds the opinion that the violation of that duty shall be regarded as defrauding under the good faith principle without referring to the defrauding by omission explicitly. But it can not be said that in this case the Supreme Court always acknowledges the crime committed by omission only on the ground that the duty exists(ⓐ). If the error was caused by the party who failed to act then the commission of fraud by omission is impossible(ⓑ).
The Supreme Court has the general criteria for distinguishing act from omission. If the decisions of The Supreme Court have consistency the distinction between the defrauding committed by an action and that by an omission should follow those criteria.
