2001년부터 시작된 소위 신용카드대란은 신용불량자 양산과 카드사 부실로 비롯된 경제위기를 초래하였다. 본고는 규제완화 및 철폐의 규제개혁 분위기 속에서 신용카드 가두모집금지 및 현금서비스한도 등의 결정에 깊이 관여한 규제개혁위원회가 카드대란에 어떤 책임이 있는지를 각 규제의 완화 내지 폐지과정을 자세히 살펴보며 분석하고, 이에 근거하여 현행 규제개혁체계의 개선방안을 모색해 보았다.
규제개혁위원회의 당시 결정과정을 자세히 살펴보면, 그 결정이 규제개혁의 원칙에는 상당히 충실했던 반면 과도기적 대응방안을 유연하게 입안하는 측면에서는 다소 소홀했다고 보인다. 즉 규제개혁위원회가 당시의 상황을 대단히 섬세하고 구체적으로 파악했다면 규제개혁의 수준이나 강도 및 일정에 다소간의 조정이 있었어야 했다. 결국 이러한 미세한 소홀과 결여가 증폭되어 심각한 문제로 비화되게 된 것이라고 본다.
본 연구는 이러한 입장에서 규제개혁체계와 규제개혁과정 및 절차 등을 중심으로 현행 규제개혁 시스템의 개선방안을 도출하였는바, 규제개혁위원회와 부처의 책임 구분의 명확화, 부처 자체규제심사위원회의 강화, 쾌속 심사제도 도입, 규제대안에 대한 부처 공무원 교육과 훈련, 규제개혁위원회 분과위원회에의 이해관계자 출석과 충분한 의견개진의 확보, 규제개혁위원회의 전문성 제고 등을 제시해보았다.The so called credit card crisis, started from 2001, led to economic crisis resulting in producing lots of the credit delinquent and the poor credit card issuers in Korea. This paper analyzes how responsible the Regulatory Reform Committee(RRC) is, for prohibiting invitation of new card members on the street and limiting cash advance on the credit card, based on examination of process of deregulation and abolition of each regulation.
Analysis of decision making process of RRC suggests that at current economic situation, those decisions of RRC seemed too faithful to principles of regulatory reform, and a little short of proposing flexible transient alternatives. That is, from the viewpoint of RRC, if RRC did understand socioeconomic situation and business environment more specifically and definitely, level and/or intensity of regulatory reform on these credit-card-related issues should have been a little more adjusted. In the end, lacking in fine-tuning and carelessness in decision making is deemed to produce very serious problem.
This paper draws suggestions on present regulatory reform system, which is centered on regulatory reform system and regulatory reform process and procedure, with understanding problems mentioned above. Followings are proposed specific suggestions: disambiguation of responsibility among RRC and each Ministry, reinforcement of Regulation Evaluation Committee of each Ministry, introduction of high-speed evaluation system, education and training on each Ministry's officer for regulation alternatives, securement of attendance of interested parties in each subcommittee of RRC and offering sufficient suggestions, and enhancement of professionality of RRC.
