판례는 공동불법행위자들 각자에게 연대책임을 인정하면서도 과실상계를 통하여 피해
자의 과실을 고려하고 자기의 부담부분을 초과하여 배상한 공동불법행위자에게는 다른
공동불법행위자에 대하여 구상할 수 있도록 하고 있다. 이는 전체 손해가 구상과 과실상계
를 통하여 복수의 공동불법행위자들과 피해자에게 배분됨을 의미한다. 공동불법행위자들
중 무자력인 사람이 있는 경우 이들의 연대책임도 그가 부담하여야 할 손해를 피해자가 아
닌 다른 공동불법행위자들에게 전가하는 결과를 가져온다는 점에서 손해의 배분과 관련
이 있다. 그러나 구상과 과실상계가 어떠한 비율로 이루어져야 하고, 또 연대책임은 언제
인정되어야 하는가에 관하여는 불분명한 점이 많았다. 이는 적어도 부분적으로는 전통적
인 견해가 이 문제를 전적으로 효율과는 무관한 형평의 문제로 보았다는 점과 관련되어 있
다. 그러나 손해배분이 효율, 특히 사고억지와 무관할 수는 없다. 구상비율과 과실상계비
율은 사고억지의 효율성에 영향을 준다. 일정한 경우 핸드 공식을 세 사람 이상이 관여한
경우에 응용하여 적절한 손해분담액을 정함으로써 효율적 사고억지에 기여할 수 있을 것
이다. 공동불법행위자들의 연대책임의 인정 여부와 그 한계도 효율적 사고억지와 관계되
어 있다. 이는 결국 누가 최소비용으로 다른 공동불법행위자의 무자력위험을 부담할 수 있
는가의 관점에서 접근할 수 있을 것이다.Some difficult problems arise when more than one party contributed a single indivisible
injury: the apportionment of loss. Under Korean tort law, like many other jurisdictions, each
tortfeasor should pay the entire loss to the victim irrespective of his degree of contribution
“( joint and several liability”). Instead, the tortfeasor who has paid more than his
proportionate share of the award, has a claim against the other jointly liable parties
“( contribution”). In addition, the damages should be reduced by the victim’s degree of fault if
the victim was also negligent “( comparative negligence”). Through the doctrine of
contribution and comparative negligence, the entire loss is apportioned. Until now, however,
the theoretical basis of these regime as well as the method of loss division has not developed.
It is - at least partly - because the traditional view considers loss division a matter of fairness
rather than effectiveness. It presumes whether this loss division should be allowed as well as
how it should be done has no effect on the efficiency of accident deterrence (efficiency
equivalence theorem). This article posits a question on this traditional view. The method of
loss division ought to have an effect on the efficiency of accident deterrence. And Hand
formula can be applied in situations more than two parties are involved. Besides, the doctrine
of joint and several liability also plays a role in both accident deterrence and loss spread,
especially when one of the tortfeasors is judgement-proof for some reasons such as
insolvency. This article provides an economic justification of joint and several liability and
some criteria for determining when to impose joint and several liability based upon the notion
of the cheapest avoider and the cheapest insurer.
