현행법상 우리나라는 자본시장의 육성이라는 정책적인 목적을 이유로 아직까지 개인에 대해서는 법적 요건을 충족하는 일부 상장주식과 비상장주식 등의 자본이득에 대해서만 과세하고 있다. 그러나 우리나라 주식시장의 규모는 선진국 수준으로 성장하였을 뿐만 아니라, 최근에는 주식 소유가 보편화되어 부의 축적 및 세습수단으로 주식이 활용됨에 따라 조세형평성 확보 차원에서 주식 자본이득에 대한 제한적 과세를 전면과세로 확대해야 한다는 주장이 제기되고 있다. 이에 본 연구는 과세제도로의 전환에 성공한 일본의 사례를 살펴보고, 이에 대한 국내 조세전문가의 의견을 검토함으로써 우리나라에 적용가능한 현실적인 과세제도 도입방안을 제시하고자 한다.
일본의 제도전환 사례가 갖는 몇 가지 특징은 다음과 같다. 첫째, 과세제도를 일시에 도입하지 않고 비과세의 범위를 점차 축소하는 방식을 통해 점진적으로 전환을 시도하였다. 둘째, 종합과세가 아닌 분리과세의 형태로 과세하였다. 셋째, 장기보유 우대 및 손익통산, 이월과세 등의 세제정책을 시행하였다. 마지막으로, 전면과세 시행 이후 10년간 증권거래세를 유지하였다. 본 연구는 이에 추가하여 일본 과세방안을 우리나라에 적용가능한지 여부를 살펴보기 위해, 국내 조세전문가를 대상으로 설문조사를 실시하였다. 분석결과 도입필요성, 분리과세 등 대부분의 항목에 대해 긍정적인 답변을 나타내었으나, 증권거래세의 유지에 대해서는 부정적 의견이 지배적이었다. 본 연구는 최근 세원 확보의 대안으로 이슈화되고 있는 상장주식 자본이득에 대한 과세문제를 대상으로 하여 제도전환의 충격을 최소화하는 현실적인 도입방안을 제시하였다는 데 의미가 있다. 또한 향후 자본이득세제 구상시 정부가 고려하여야 할 중요한 시사점을 제공하였다는 데 공헌점이 있다.The current Income Tax Law in Korea levies taxes on capital gains generated from listed stocks consigned by large stock-holders and unlisted stocks traded between stockholders. The trading of listed stocks among minority shareholders, however, has been exempted from taxation. This policy has been maintained not to impede the smooth influx of funds into the capital market. But now that Korean stock markets are at a world-class level in terms of trading volume and infrastructure, it is necessary to reexamine whether this type of tax assistance system is sufficiently justifiable to remain in existence in the future. We argue that the existing taxation system needs to undergo improvements so that it could accommodate taxation on capital gains from all sources, which is deemed desirable from fairness perspective. As a way to justify our arguments, we place a special focus on Japanese case since Japan is arguably the only country that experienced a successful transition to a regime which levies taxes on all capital gains. We also conduct a brief questionnaire survey on the opinions of the practicing tax accountants to reflect upon their general views about the possible reforms.
The results of the reviews are summarized as follows: firstly, Japan has gradually transformed its system by expanding the scope of the taxation. Secondly, Japan introduced the separate taxation system. Third, Japan enforced the special deduction for the long-term ownership, loss credit, and the deduction carry forward. Finally, Japan maintained the stock exchange tax for 10 years after the reform. The examination of the questionnaire survey responses reveals that the majority of Korean Certified Tax Accountants are in favor of the introduction of capital gains tax system, benchmarking the Japanese case, except for the maintenance of the stock exchange tax.
