대법원은 대상판결(대법원 2006. 11. 9. 선고, 2004다67691 판결)을 통해, 설계도상 18층인 집합건물이 원래건축주에 의해 6층까지, 중간승계건축주에 의해 17층까지, 최종승계건축주에 의해 나머지 부분이 각각 건축되어 완공된 집합건물에 대해 그 원시취득자를 최종승계건축주라고 판시하였다. 이는 종래 판례(대법원 2005. 7. 15. 선고, 2005다19415 판결)를 변경하거나 폐지함이 없이 원시취득자를 달리 인정한 것으로 문제가 있다고 하지 않을 수 없다.
종래 대법원판례는 건물로서의 외관을 갖춘 상태에서 건축이 중단된 경우 이를 승계받아 건물을 완공한 경우에는 처음 건물의 외관을 형성한 자에게 원시취득이 인정된다고 하였다. 그 이론적 근거로 부합의 법리를 제시하였다. 즉 부동산(기존의 건물 외관 형성 상태의 미완성건물)에 동산(추가공사자재 투입분)이 부합되었으므로, 민법 제256조에 의해 최초의 건축자가 추가공사부분에 대해서도 원시취득자로 인정된다는 것이다.
그런데 대상판결은 이와 달리 최종승계건축주가 건물 전체에 대한 원시취득자가 된다고 하여 종래 판례와 다르게 판시하고 있다. 그 이유로, 집합건물은 전체로서의 건물을 하나의 건물로 보아야 하고, 집합건물은 건축물대장이 작성되는 시점에 소유자가 확정되며, 기술적으로 어느 부분을 어느 건축주가 특정하여 건축하였는지 분별할 수 없는 한계 때문에 최종승계건축주가 건물 전체에 대한 소유권을 원시취득한다고 하고 있다.
그러나 이러한 판례의 태도는 잘못되었다고 하지 않을 수 없다. 건물의 건축과정은 최초 원자재가 투입될 당시는 동산 상태일 뿐이고, 어느 정도 건물로서의 외관을 갖추게 되면 비로소 독립된 소유권의 객체성이 인정되므로 통상의 부합의 법리를 따를 수 없는 특수성이 있는바, 각각 건축한 부분에 대한 원시취득을 인정하고, 이를 특정할 수 없는 경우에는 공유관계로 인정하는 것이 타당하다고 하겠다.The Supreme Court of Korea held, through the decision (S.Ct. 2006.11.9. 2004da67691) that an original acquisitor of an aggregate building, built up to the 6th floor by a beginning architect, up to the 17th floor by a succeeding architect in the middle-stage, and completed by a final architect who constructed remaining parts, is the final architect. The decision is problematic because it acknowledged an original acquirer in a different way from the former decision (S.Ct. 2005.7.15., 2005da19415) without revising or repealing explicitly the former decision.
The former decision of the Supreme Court had held that the predecessor who made the look of the original building at the first stage was the original acquisitor even when construction was stopped with the building's outward appearance and a successor took it over and completed the construction of the building. The Supreme Court had reasoned the decision with theory of addition. In other words, as effects (inputs of construction materials additives) are added to the real property (uncompleted building with the outward appearance), the first architect, under art. 256 of the Civil Code of Korea, becomes the initial acquirer of additional parts under construction.
However, the decision (2004da67691) opined, in a different way from the former decision, that the finally succeeding architect became the original acquisitor of the whole building. The reason is that the aggregate building is one building as a whole, that the owner of the aggregate building is decided at the time when building ledgers are established, and that the finally succeeding architect acquires the ownership or title of the whole building due to technical limitation of discerning which part was built by which architect.
However, the attitude of the decision cannot help being criticized. While a building under the procedure of construction are merely effects in a stage when raw materials are to be invested, the building cannot be the object of an independent ownership until it has the outward look as an independent building by a certain level, which makes a characteristic distinguished from objects under theory of addition. The thesis argues that more reasonable rule will be that each constructed part should belong to its architect as the initial acquisitor and that if the part cannot be acknowledged as the object of ownership, it should be commonly owned by total architects.
