본 연구는 지난 2008년 10월 11일 미국정부가 북한을 테러지원국 명단에서 삭제한 것이 남북경협에 미치는 영향을 법적 측면에서 검토함으로써, 북미관계의 개선에 따른 남북경협의 향후 과제를 제시하는 것을 주된 목적으로 한다. 이를 위해 대북한 교역 및 투자에 적용되는 미국 국내법규와 유엔 결의 및 국제규범의 주요 내용을 간략히 소개하였고, 테러지원국 해제가 남북경협에 미치는 영향을 전략물자수출통제의 완화와 금융지원의 확대를 중심으로 검토하였다.
이 글은 미국의 북한 테러지원국 해제가 대북 수출통제 및 경제제재를 해제함으로써 대북 무역거래 및 투자를 자유롭게 할 것이라는 일부 전문가들의 견해에는 오류가 있음을 지적하였다. 미국 수출관리규정(EAR)상 전략물자 수출허가를 위한 최소수준이 기존의 10%에서 25%로 완화되어 관련 물자의 대북 반출이 다소 완화되는데 불과하기 때문이다. 즉 미국산 품목의 편입비율이 25% 이하인 외국산 품목의 재수출은 미국 정부당국의 사전 허가없이 북한에 수출할 수 있게 된다. 북한에 대한 유엔 안전보장이사회의 경제제재 결의(1540, 1695, 1718)와 다자간 수출통제체제(WA, NSG, AG, MTCR 등)상의 다자간 수출통제규칙 또한 북한 테러지원국 해제에도 불구하고 북한에 대해 여전히 적용되는데, 이 또한 북한과의 무역거래 및 투자를 어렵게 하는 장애로 기능하고 있다.
다만 북한이 테러지원국에서 해제되었기 때문에 테러지원국에 대한 국제금융기구의 지원을 금지하고 있는 미국의 ‘국제금융기구법’과 ‘브레튼우즈협정법’ 등의 적용을 받지 않게 되므로 국제통화기금(IMF)과 세계은행(IBRD)과 같은 국제금융기구의 대북 투자개발 및 금융지원이 가능하게 되는 것은 테러지원국 해제로 북한이 얻게 되는 중요한 성과라 할 수 있다. 과거 북한처럼 테러지원국으로 지정되어 유엔과 미국의 경제제재를 받았던 리비아가 WMD 개발 프로그램의 포기를 선언함으로써 경제제재에서 벗어나고, 에너지자원의 개발을 통해 괄목할만한 경제성장을 이루고 있음은 북한당국에게 시사하는 바가 크다. 따라서 북한의 경우도 테러지원국 해제 이후 북미관계가 개선되면 미국은 유엔의 대북 경제제재 결의를 철회하는 것을 주도하고, 대북 관련 법제의 정비 작업도 함께 추진할 것으로 예상된다. 그러나 미국과 유엔이 대북 경제제재를 해제하여 경제성장을 위해 북한이 필요로 하는 물자와 자금을 활용하기 위해서, 북한당국은 무엇보다 WMD 개발 포기 및 비확산 정책을 선언하고 6자회담에서의 합의사항을 성실히 이행하여야 할 것이다.On 11 October 2008, the United States of America (U.S.) removed North Korea from the list of terrorist supporting countries under the U.S. export control regulations. The purpose of this study is to analyse its effects on economic transactions with North Korea, and propose the future tasks for the expansion of economic cooperation between South Korea and North Korea("South-North economic cooperation") after the normalization of diplomatic relationships between North Korea and the United States. For this purpose, this article introduced major contents of export administrations regulations(EAR), the United Nations(U.N.) Security Council Resolutions, and other international rules that might be applied for the trade with and investment in North Korea, and reviewed the effects of the removal of North Korea from the list of terrorist supporting countrie, in terms of export control on strategic items(commodities, software and technology) against North Korea and financial assistance for North Korea.
This article pointed out that economic transactions with North Korea would be not so much expanded as expected after the removal of North Korea from the list of terrorist supporting countries. With certain exceptions, a reexport to a country (such as Cuba, Iran, North Korea, Sudan, Syria) designated as a terrorist supporting country is subject to the EAR if the item involved contains greater than 10% controlled U.S. origin content by value. Since North Korea was removed from the list of terrorist supporting countrie on 11 October 2008, foreign-made items incorporating controlled U.S. origin items at 25% or less of the total value of foreign-made items are now not subject to the EAR. However, economic sanctions have been imposed on North Korea under the UN Security Council Resolutions(1540, 1695, 1718), and international rules under the multilateral export control regimes including Wassenaar Arrangement(WA), Nuclear Suppliers Group(NSG), Australia Group(AG), Missile Technology Control Regime(MTCR) have been applied against North Korea even after the removal of North Korea from the list of terrorist supporting countries.
Once removed from the list of terrorist supporting countries, North Korea may not be subject to the U.S. financial regulations which forbid to provide financial assistance for terrorist supporting States. Financial assistance available for North Korea by IMF and IBRD may contribute to the economic development of North Korea. It should be noted that Libya could get out of economic sanctions imposed by U.S. and U.N. and carry out economic development successfully, only after Libya gave up the development of the weapons of mass destruction(WMD) programs. If diplomatic relationships between North Korea and U.S. are normalized in the near future, U.S. is expected to initiate the withdrawal of U.N. Resolutions calling upon members to impose economic sanctions on North Korea and is likely to revise national regulations against North Korea. However, if North Korea really wants to use high-technology items and financial resources necessary for its economic development, North Korea must give up the development of WMD programs, declare a policy of non-proliferation, and implement in good faith without delay the agreements adopted at the 6 party talks.
