Arbitration is a vital dispute settlement mechanism nowadays, the resolution of the arbitral award has to be executed by both parties. To make it be effected in reality, it requires that not only both parties have to obtain the awards, but also the state through its judicial arm, the courts should recognize and enforce the arbitral awards. There might be some barriers that restrict the prevailing parties to find an accept from receiving states because of conflicts on benefits. The procedure is, therefore, the key. This dissertation seeks to analyze the rules relevant to the recognition and enforcement of foreign arbitral awards in Vietnam as well as to evaluate the effectiveness of Vietnam's recognition and enforcement framework, especially against the backdrop of Article V (1) and (2) of the New York Convention.
