In term of Globalization, it makes the world markets easier by sharing a single economy as a very large and strong across the scope. After the end of World War II when the idea of bringing peace to the world existed, some countries decided to open markets by from universal principles which are under the only global international organization known as The World Trade Organizations (WTO). The goal of opening the single markets is to encourage all producers of the goods and services can do trade freely among WTO members without having any struggles while conducting their business. Even though WTO is seeking to make a fair trade, one side does not fit all members because The General Agreement on Tariffs and Trade (GATT) of WTO cannot perfectly govern the whole things. Due to the gap in the law, many countries have severely affected indirect ways from other countries that have better technologies. In the case of Cambodia society nowadays, it faces the problem cheap products indirect way from neighboring countries, and other countries that can produce the products cheaper than domestic products of Cambodia. On 27th October 2017, National Assembly of Cambodia adopted the draft law on Anti-Dumping, which was designed to shield domestic producers from the impact of dumping by foreign exporters. However, the law does not have legal effective enough to be enforced in actual since there is no case that other countries dump their products in Cambodian markets. In contrast, Cambodia is suffering indirect ways from other countries that could produce the produces at a lower price than Cambodian can do due to their updated technologies, and cheap labor force. Therefore, the aim of this dissertation paper will be discussed about special characteristic of WTO Safeguard measures in the particular circumstance that it can be applied in Cambodian markets while cheap foreign imported products flow into country nowadays. Moreover, Anti-Dumping Law also will be critically analyzed in order to distinguish the differences between dumping products, and products which have a low price than domestic products in Cambodian markets. By making to the analysis of these two factors, it will have the new proposal in order to balance between Safeguard measures and Anti-Dumping Law to protect domestic industry in Cambodia which has been suffered from cheap foreign imported products by using WTO framework.
