In the generation of the innovation and integration, thousands of inventions originated from people's creativity have been born. The products are the combinations of ideas, which are launched into the real practice to meet the demand of society members and economic growth. However, they will be easily stolen by intellectual property thief without being protected by intellectual property laws. Among various forms of intellectual properties, trademark is one of the protected subjects playing a very important role in the development of economy. It promotes the company business by supporting the customers to identify the source of goods or services and make purchase from such recognized mark. Accordingly, the violation of trademark definitely brings negative consequences on the sales and profits of trademark holders, benefits of customers and government as well. For those reasons, it must be excluded promptly.
Trademark infringement is not a strange problem in Vietnam, it is occurring throughout everywhere from north Vietnam to south Vietnam. The customers can easily find out counterfeit goods in many shopping streets or markets which are opened for sale publicly. The disadvantages on provisions of trademark provided in Vietnam Intellectual Property is one of the main reasons making the increase of trademark violation that raise difficulties in dealing with the problem. Therefore, this comparative study on trademark infringement under the United States and Vietnam legal system opens a opportunity for Vietnam to make progress from the betterment of United States on trademark protection. This thesis also focuses on several core points which are organized as follow:
