The purpose of this dissertation is to elaborate the issue of the violation of human rights against the Rohingya Muslim which is the minority group in Myanmar. Moreover, it is the hot issue for today topic. The Rohingya crisis calls for the international community to pay more attention to this problem. The Rohingya have been denied their citizenship since the entry into force of the 1982 Citizenship Act. Due to most of the Rohingya leak of the legal documents to prove their civil rights to be entirely the citizenship in Myanmar. Also, they have a difficulty to access to the public care and many more benefit for the Myanmar people. In this dissertation, will discuss the rights that the entire Rohingya can genuinely enjoy in their own country, and the international that can protect them from being violated their rights.
This dissertation divided into 6 Chapters:
Chapter 1, "Introduction" will give a brief introduction to the topic; aim and objective of study; scope and research method.
Chapter 2, "General Overview of Rohingya People," provides the current situation of human rights of Rohingya Muslims. Additionally, will illustrate the human rights abuses against Rohingya in Myanmar. For instance, arbitrary deprivation of nationality, restriction of freedom of movement, threats to life, liberty and security, sexual and gender-based violence, denial of the right to health and education, and many more restriction to them.
Chapter 3, "Legal Framework of the Protection on Minority Rights under the International Human Rights Law," this chapter will talk about the international law instruments to protect the rights of the minority - Rohingya. The international human rights law that governs the rights of all humankind has Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, Convention on the Elimination of All Form of Discrimination against Women, Convention on the Prevention and Punishment of the Crime of Genocide, and so on. Moreover, it also provides the regional law, for example, ASEAN Charter, and ASEAN Human Rights Declaration.
Chapter 4, "International Responses on Rohingya Issue and Responsibility to Protect the Rohingya," this chapter will explain about responses on the Rohingya Muslim Crisis, in which responses from the international community such as; from European Union, the United States, ASEAN, and neighbouring countries on this issue. Moreover, this chapter will also illustrate the Responsibility to Protect (RtoP) the Rohingya minority.
Chapter 5, "International Criminal Liabilities under the International Law," this section will examine two different kinds of crime which most likely committed by the Myanmar government. The crime that likelihood perpetrated by the security forces is a crime against humanity and genocide. In this chapter, also contains the case study to give more information, and it is the central chapter of this dissertation.
Chapter 6, "Recommendations," this chapter gives the recommendations to further the development on the Myanmar government, recommendations to the international community and Organization, the compulsory of an ICC Referral from UN Security Council. Last but not least, Chapter 7 "Conclusion" which is the last chapter of the dissertation.
