The protection of the Rights of Migrant Workers being engaged with a job outside their own countries has all the times been an issue for both Sending and Receiving States at every region, especially in European Union and ASEAN Community. Nowadays, UN System are systematically taking deeper and serious concerns toward this problem. Indeed, we can base on a large cluster of International, Regional and National Legal Instruments regulating the labor Standards as well as their own policies to protect and promote the living and working conditions of such persons.
With an aim to boosting their living conditions, under the purpose of this paper, I myself would like to dig deeper into the frameworks of intraregional movement of labor, point out the similarities and differences between European Union and ASEAN Community. Furthermore, those are the principles that led to the establishment of their own approaches toward the issue of Migrant Workers followed by the actual situation of their protection progress in these two regions. The content of this paper includes five main Chapters as follows:
In Chapter I, I would like to give you an overview as an Introduction, which providing the list of relevant current legal issues in both European Community and ASEAN Community as known as the main content of this Paper. Additionally, this Chapter also points out the objectives of study, limitation as well as the research Methodology I have used to create these words.
In Chapter II, there will be a Global overview under the International Legal Framework regarding the Protection of the Rights of Migrant Workers. This Chapter indicates the definitions of Labor Mobility, Migrant Workers and other key terms, as well as the current trends and emerging Migration Issues under the implementation of systematic International Legal Instruments.
The main purpose of Chapter III is to examine whether the legal protection of Migrant Worker Rights in EU completed or not in the context that not all EU Member States have ratified the relevant UN and ILO Conventions. Whether there has anything 'else from the EU mechanism to fulfill the gaps? And there are the solutions to deal with the emerging migration issues improving an efficient protection?
Additionally, there has another special subject of Migrant Workers in Europe needing the protection, the Migrant Workers being the Third-Country Nationals. Therefore, within the scope of this Chapter, I would like to concentrate on the achievements and challenges of both internal mobility of EU and the movement of Third-country Nationals, those who aim to work as Workers in Europe. To what extent are Migrants, whether they are EU citizens or Third-country Nationals, capable of looking for a job or becoming self-employed, sponsoring their families and boosting up the economy of the host country or not? What kind of difficulties they have to suffer now an in the future? Are they beneficial or harmful consideration for the native labor? Therefore, what is the need for the promotion of the protection of Migrant Workers created by the Authorities?
Moreover, Chapter IV elaborates on the practice of ASEAN under the discussion on the implementation and ratification process of International and Regional Legal Instruments. Being a newborn community, the percentage and Migration Status in ASEAN is still weak and inefficient compared to others. Under the establishment of AEC, ASEAN are gradually striving hard. It seems that they never give up their efforts against the difficulties and challenges toward the Protection of Migrant Workers.
In Chapter V, I will shed lights on the efficient implementation of legal instruments and collaboration among the States at both national, regional and International levels heading to the prospects of the world regarding the Rights of Migrant Workers.
Finally yet importantly, I end up with Chapter VI, a conclusion of this research paper. It is the summary of all above main content, and once again, consolidates and reinforces the final solutions to each region regarding the burdens coming from the living and working conditions of Migrant Workers all over the world.
Basing on the systematic research on fundamental Rights of Migrant Workers and their freedoms of movements as well, I hope this paper could provide general overviews and contribute much in raising the awareness of the society, especially the authorities, policy-makers, managers etc. and their significant roles in the Protection and Promotion Process of the Rights of Migrant Workers.
