The principle of faith and trust is to urge a man to act based on faith and trust so that he does not betray others' trust living together. The root of the principle dates back to as far as the Roman law and it was a general law originally designed to define the relations of rights in private law.
Today, the principle of faith and trust is accepted a valid principle in not only private law but also the tax law, which is one of the representative public laws. Accordingly, the principle of faith and trust is now being utilized in the almost every field of today's law. From a long time ago, strenuous efforts have been made to illustrate even partial relations in public law on the basis of the principle of faith and trust.
In particular, since tax liabilities and tax claims, which are the centerpiece of the taxation-law relation, are essentially similar to the legal relations of credit in private law, the principle of faith and trust is applicable in the public law area. However, it is being criticized for whether the principle of faith and trust can be applied even to taxpayers' words and actions.
Therefore, after examining theoretical foundations of the principle of faith and trust as well as tax law related provisions in the positive law and analyses to them, measures for improvement and new analysis will be presented in this study. How the principle of faith and trust can be applied to relations between the taxation government departments and taxpayers will be covered one by one as follows.
First, legal relations in the tax law are governed by the principle of No Taxation without Law. However, in terms of applying the principle of faith and trust, which is a moral regulation, it is prescribed that the principle of faith and trust is regarded as an express provision in the law of a national tax when applied to both taxpayers and government departments of taxation. Regarding this, there is a criticism that whether applying the principle even to taxpayers is right or not while government departments of taxation should be under the principle of faith and trust.
Together with a theoretical basis, this study asserts that legal relations in the tax law should be considered based on tax liabilities and tax claims under the principle of self-assessment of taxation and the infringement on the principle of faith and trust can be possibly caused by discordance between words and deeds of taxpayers.
Second, as today's tax law is, with reflection on the economic policies, specialized, complicated and includes more and more technological contents, taxpayers increasingly rely on the decisions of government departments of taxation. In this regard, taxpayer's trust in such decisions should be protected.
Third, window dressing accounting, which is a crime and an immoral act, has significantly adverse impacts on the public order and the national economy.
The overpaid taxes, which amount to national tax refunds, are not the only thing that taxpayers who have involved in window dressing accounting can get back by filing a suit of reassessment of corporation taxes.
Therefore, as for the government, it is unreasonable torefund a large amount of taxes paid for years, to get into the financial difficulties and even to pay interests totaxpayers who have deceitfully overpaid their taxes.
