UN은 2015년 ‘지속가능발전의제(2030 Agenda for Sustainable Development)’를 채택하고, 2030년까지 빈곤 종식 등 지속가능한 발전의 실현을 위해 17개 목표와 169개 세부 목표를 제시하였다. 북한도 이에 호응하여 ‘사회주의 강국 건설을 위한 경제발전 5개년 전략(2016-2020)’ 달성을 위해 UN SDGs를 북한의 국가 발전 목표와 연계시켜 ‘우리식 SDGs’를 표방하고 있다. 특히, 북한은 VNR 보고서를 통해 SDGs 17개 목표별 북한의 이행 현황 및 주요 문제점, 2030년까지 SDGs 달성을 위한 추진 성과와 도전과제, 우선순위 등을 제시하면서 UN SDGs 이행을 위해 북한 환경법제를 정비하고 있다. 대한민국도 「지속가능발전 기본법」을 제정하여 이를 시행하고, 2040년을 목표로 지속가능발전기본계획을 수립하는 등 UN SDGs에 맞추어 대한민국 환경법제를 정비하고 있다. 이처럼 UN SDGs는 대한민국과 북한 모두의 환경법제 변화를 이끌어내는 공통의 기준이 되고 있는 점, 환경분야는 비정치적인 분야로서 비교적 남북 간에 합의하기 쉬운 분야이자, 공통의 이해관계가 있는 분야라는 점 등을 감안할 때 UN-SDGs를 고려한 남북한 환경법제 통합 방향을 설정하는 것은 중요하다. 남북한 환경법제 통합 방향으로 먼저, 대한민국은 자유민주적 기본질서에 입각한 법제 통합 방향이라는 본질적·내재적 한계와 통일정책 방향성이 있다는 점을 유의하면서 협상할 필요가 있다. 그리고 국제사회의 대북제재가 존재하는 국제질서의 현실을 감안하여, 남북한 환경분야 법제 통합도 ① 북한의 비핵화조치 이전 단계, ② 북한의 실질적 비핵화 돌입 단계, ③ 북한의 완전한 비핵화 단계 등에 맞추어 단계적 접근법을 갖추어야 한다. 마지막으로 남북한 환경법제 통합작업은 전반적인 남북한 법제 통합의 맥락에서 추진되어야 하기 때문에 남북한 법제 통합의 주무기관이라고 할 수 있는 법무부를 주축으로 하여 법제처, 환경부와 통일부 등이 참여하고, 민간 분야에서는 남북법제 통합전문가, 환경전문가 등이 참여하는 구조로 통합작업의 추진 체계를 수립하는 방안이 바람직하다.
The United Nations adopted the 2030 Agenda for Sustainable Development in 2015 and proposed 17 goals and 169 targets to realize sustainable development, including ending poverty by 2030. In response, North Korea has been advocating for “North Korean-style SDGs” by linking the UN SDGs to North Korea’s national development goals to achieve the Five-Year Strategy for Economic Development to Build a Socialist Power (2016-2020). In particular, North Korea is revamping its environmental legislation to implement the UN SDGs through the VNR report, which presents North Korea’s implementation status and major problems for each of the 17 SDGs, as well as progress, challenges, and priorities for achieving the SDGs by 2030. The Republic of Korea has also enacted the “Basic Act on Sustainable Development” and implemented it, as well as established a Sustainable Development Framework Plan for 2040, to align its environmental legislation with the UN SDGs.
Given that the UN SDGs have become a common standard to guide changes in environmental legislation in both South Korea and North Korea, and that environment is a non-political field that is relatively easy to agree on between North and South Korea, as well as a field with common interests, it is important to set a direction for the integration of environmental legislation in North and South Korea that takes into account the UN-SDGs.
First, it is necessary to negotiate the direction of inter-Korean environmental legislation integration while keeping in mind the inherent limitations and unification policy direction of the ROK, which is based on the liberal democratic basic order. In addition, given the reality of the international order with sanctions against North Korea, the integration of environmental laws between the two Koreas should be conducted in a phased approach, including (1) the phase before North Korea’s denuclearization measures, (2) the phase of North Korea’s substantial denuclearization, and (3) the phase of North Korea’s complete denuclearization. Finally, since the integration of environmental laws between the two Koreas should be promoted in the context of overall inter-Korean legal integration, it is recommended that the Ministry of Justice, which is the lead agency for inter-Korean legal integration, establish a structure to promote the integration, with the participation of the Legal Affairs Division, the Ministry of Environment, and the Ministry of Unification, and the private sector, including experts in inter-Korean legal integration and environmental experts.
