이철수 교수에 따르면, 노동법학 방법론은 ‘가치지향적 접근’(value-oriented approach)과 ‘기능지향적 접근’(function-oriented approach)의 두 가지 방식으로 대별된다. 전자는 근로자 보호 및 노동인권 보장을 우선순위에 두는 정통 노동법의 방법론이며, 후자는 변화하는 산업구조에 조응하고자 하는 관점에서 노동과 자본의 결합을 도모하고 노동시장과의 정합성을 염두에 두는 방법론이다. 노동법에 있어 가치지향인가, 기능지향인가 하는 문제는 노동법학 방법론은 물론이지만 노동법의 기본 목적을 무엇으로 이해할 것인가 하는 보다 근본적인 질문과도 맞닿아 있다.
본 논문은 이철수 교수가 제시한 개념틀을 계기 삼아, 소위 ‘노동의 미래’ 담론 속에서 노동법 및 노동법학의 근본 목적을 재확인하고자 한다. 법학으로서의 노동법학은 규범학이기에, 노동의 미래에 대한 전망 속에서 그 근본 방향이 흔들려서는 안 되며, 오히려 ‘미래의 노동’의 방향을 선언하고 제시할 수 있어야 한다는 것이 이 글의 핵심 견해이다.
이러한 논의를 위하여 본 논문에서는 먼저 노동의 미래 관련 사회과학적 논의를 소개하되 이를 비판적 시각으로 검토한 뒤(II), 이철수 교수가 제시한 ‘가치지향적 접근’과 ‘기능지향적 접근’이라는 개념틀 그리고 서구 노동법학에서 전개된 Hugo Sinzheimer를 시초로 한 정통 노동법(labour law)의 이론과 신자유주의 이후 등장한 노동시장의 법(law of the labour market)이론을 비교, 대조하며 후자에 대한 비판론을 살펴본다(III). 다음으로 21세기 이후 인공지능의 확산 등 디지털 기술혁신, 팬데믹의 경험과 심화되는 생태위기 맥락 속에서 노동권과 생존권의 중요성이 재부상하고 있음을 상기하며 ‘노동법의 갱신’(更新, renewal)이 필요한 시점에 이르렀다는 것을 논증한다(IV). 마지막으로 노동법학 방법론에 대한 반성적 성찰, 특히 법사회학적 방법론의 중요성에 대한 생각을 덧붙이는 것으로 끝맺는다(V).
According to Prof. Cheol-soo Lee, labour law methodology could be divided into two ways: value-oriented approach and function-oriented approach. The former is a traditional method of labour law that prioritizes worker protection and labour rights, and the latter is a method of combining labour and capital to meet the need of changing industrial structure and considering consistency with the labour market.
The question of value-oriented or function-oriented approach in labour law is not only related to the methodology of labour law, but it also relates to the more fundamental question of how to understand the basic purpose of labour law. This article aims to reaffirm the fundamental purpose of labour law in the face of ‘future of work’ or ‘crisis of work’ discourse, using the conceptual framework proposed by Prof. Cheol-soo Lee.
I argue that the fundamental purpose and direction of labour law should not be shaken despite the dominant discourse on the crisis of work. Rather, the importance of labour and human rights have resurfaced in the context of digital transformation, the experience of Covid-19 pandemic, and ever deepening ecological crisis. The importance of labour law, and most of all, its value-oriented approach towards the protection of workers, should be reaffirmed and renewed in the 21C workplace.
