“특별계획구역”은 지구단위계획구역 중 지구단위계획에서 일반적으로 허용되는 개발 밀도보다 더 높은 밀도의 개발이 요구되어 ‘특별하게 계획되어야 할 구역’에 지정된다. 특별계획구역 제도는 우리나라 대도시의 주요 대규모 개발사업에 널리 활용되어 온 도시계획 기법임에도 불구하고, 명시적인 법령상 근거에 따라 통제되기 시작한 지 얼마 되지 않았다. 오늘날 특별계획구역은 국토계획법상 지구단위계획구역의 특수한 형태로 규율되고 있으나, 특별계획구역의 도시계획적 중요성에 비하면 특별계획구역의 정의, 지정 요건 및 법적 효과 등은 명확히 규정되지 못하고 있다.
특별계획구역은 고밀도 개발이 필요하지만 아직 개발의 방향이 구체적으로 확정되지 않은 곳에 지정된다. 특별계획구역이 지정된 이후 시간이 흐르면서 후속하는 개발안이 마련되면, 다시 특별계획구역의 내용이 구체화되어 건축허가와 연결된다. 특별계획구역을 정할 때 구역의 위치와 면적을 확정하는 것이 주된 규율이지만, 당해 구역의 용도지역을 포함한 개발의 기본방향도 부대적으로 규율되며, 이를 정하는 과정에서 행정청에게 넓은 선택의 폭이 부여된다. 또한 특별계획구역이 지정된 후 일정한 시간이 지나 개발사업이 진행되는 단계에서, 도시계획위원회가 또다시 다양한 도시계획적 관점에서 개입하면서 재량을 행사하게 된다.
행정청이 특별계획구역에 관한 각종 도시계획 수립과정에서 누리는 재량은 행정법상 계획재량에 해당하고, 행정청은 통상적인 재량행위에 비해 더 넓은 형성의 자유를 갖는다. 특별계획구역을 지정하고 개발사업을 시행하는 절차에서 행정청에게 부여되는 계획재량은 국토의 합리적 이용이라는 공익을 달성하기 위한 수단이기도 하므로, 무제한적이지 않고 일정한 한계를 갖는다. 특별계획구역과 관련된 행정청의 계획재량 역시 사법심사의 대상이 되어야 하는데, 특별계획구역에 관한 재량통제의 기준을 더 이상 기존의 실무 관행에 의존하지 않고 법률에 근거하여 확립하기 위해서는 특별계획구역의 개념과 법적 성질에 대한 연구가 필요하다.
A “Special Planning Zone” is designated in a District Planning Zone that requires a higher density of development than is permitted under the urban planning regulations set forth in the general District-Unit Plans and therefore requires special planning. Despite it being an urban planning technique that has been widely utilized in major large-scale developments in Korea's metropolitan areas, the legal provisions regulating Special Planning Zones have only recently been introduced. Today, Special Planning Zones are regulated as a unique form of District Planning Zones under the National Land Planning and Utilization Act. Considering their significance in urban planning, however the definition, designation requirements, and legal effect of Special Planning Zones are still not clearly defined.
Special Planning Zones are designated where high-density development is desired but the direction of development has not yet been specifically determined. As time passes after the designation of a Special Planning Zone, subsequent development plans are formulated, leading to the concretization of the content of the special planning zone and its connection to building permits. While determining the location and area of the zone is the main regulation when designating a Special Planning Zone, the basic direction of development, including the land use within the area, is also indirectly regulated. The process of designating a Special Planning Zone also grants a wide range of discretion to the administrative agency involved. In addition, after a certain period of time has passed since the designation of the Special Planning Zone when the development project is underway, the Urban Planning Committee will again exercise its discretion by intervening from various urban planning perspectives.
The discretion that administrative agencies enjoy in the urban planning process for Special Planning Zones falls under the category of “planning discretion” under the administrative law. Compared to ordinary discretionary actions, administrative agencies have a broader range of freedom of formation in their discretionary actions regarding Special Planning Zones. Because the planning discretion granted to administrative agencies in the process of designating Special Planning Zones and implementing development projects serves as a means to achieve the public interest of rational land utilization, however, it has certain limits and is not unlimited. Accordingly the planning discretion of administrative agencies in relation to Special Planning Zones should also be subject to judicial review. It is necessary to study the concept and legal nature of Special Planning Zones in order to establish the standards of discretionary control over Special Planning Zones based on the law and no longer rely on existing practice.
