이 글에서는 박정훈 교수의 비교행정법 연구를 돌아보고 향후 행정법학의 발전에 주는 시사점을 검토해보았다. 박정훈 교수는 독일, 프랑스, 미국, 영국 등의 행정법을 종합적으로 비교하는 ‘다원적 비교법’ 방법론을 적용한 연구를 진행해온 바 있다. 또한 행정소송법 분야 이외에도 행정심판법, 행정절차법, 국가배상법, 공법과 사법의 구별, 행정조달계약 등 행정법의 다양한 분야들에 대해서 일관되게 다원적 비교법 방법론을 적용하여 우리나라 실정에 맞는 법리를 발전시키고자 노력하여 왔다. 이러한 박 교수의 연구는 독일위주의 비교법연구에 많은 영향을 받던 기존의 우리나라 행정법학계에 신선한 충격을 주고, 프랑스, 영국, 미국 등의 법을 다각적으로 비교함으로써 새로운 시각을 열 수 있는 기회를 제공한 것으로 볼 수 있다.
박 교수의 비교행정법 연구 및 국내외 비교행정법 연구동향을 기초로 다음과 같은 향후 연구과제를 제시해볼 수 있다. 첫째, 법계와 비교행정법에 관해서 보면 프랑스, 독일, 영국, 미국 등의 원형모델에 대한 연구는 여전히 중요하다고 할 수 있다. 다만 대통령제와 의원내각제, 권한의 분산과 통합에 대한 비교헌법적인 논의를 고려하면서 비교행정법 연구를 시행할 필요가 있다. 스칸디나비아 국가들의 사회복지법제 및 네덜란드의 행정법에 대한 비교연구도 필요하다.
둘째, 비교행정법 연구방법론과 관련해서는 ‘발전국가론’과 같은 정치경제학적인 논의, 사법기관 상호간의 관계에 대한 법사회학적인 분석 등을 토대로 비교행정법 연구를 실시할 필요가 있다. 이는 한국행정법의 고유성을 밝히고, 더 나아가 동아시아 행정법이 독립적인 법계로 자리매김하는 데에 필수적이라고 할 수 있다.
셋째, 비교행정법 연구대상과 관련해서는 행정법을 넓게 이해하는 전제하에 계약의 형식에 의한 행정작용, 규제법, 인권과 행정법간의 관계 등에 대해서 연구가 이루어질 필요가 있다. 또한 독일의 신사조행정법학에서 중시하는 ‘조종’(Steuerung)과 미국의 행동법경제학에서 ‘넛지’(nudge) 등의 개념을 비교하고 우리나라에의 시사점을 분석하는 노력도 필요하다.
This article sees the Professor Park, Jeong-Hoon’s comparative administrative law study and lessons from this study. Professor Park has conducted in ‘pluralistic comparative law’ in administrative law field, which encompass France, Germany, United Kingdom (UK), and United States (US). Based on this methodology, he dealt with various administrative law field, such as administrative litigation, state liability, distinction between public law and private law, and government procurement contract. Professor Park’s comparative study impacted on administrative law society in Kroea and opened the eye for various legal system.
Based the Professor Park’s study and other comparative law research literatures in various countries, following future tasks can be suggested. First, from the perspective of legal family and comparative administrative law, original administrative model, such a France, Germany, UK, and US is still important. In conducting comparison with these models, it is crucial to reflect the comparative constitutional law research on Presidential/Parliamentary system and diffusion and integration of power. Social welfare law in Scandinavian countries and Dutch administrative law should be also included as a reference.
Second, in relation to methodology of comparative administrative law, political economic theory such as ‘developmental state’ and sociology of law analysis on the relationship between judicial institutions should be implemented in comparative administrative law. These methodologies are indispensible to reveal the uniqueness of Korean administrative law, and to establish East-Asia administrative law as a independent legal family.
Third, the scope of “administrative law” should be understood as inclusive, and government’s use of contract, regulation, and relationship between human rights and administrative law should be the object of comparative administrative law field. Furthermore, “steering”(Steuerung) in German new administrative law should be compared with “nudge” in US’ behavioural law and economics and implications for Korea should be drawn from this comparison.
