2020년 11월에 『정의의 감정들(조선 여성의 소송으로 본 젠더와 신분)』이라는 제목의 한국어판이 출간되었는데, 원저의 제목은 『The emotions of justice : gender, status, and legal performance in Chosŏn Korea』이다. 이 논문은 이 저술에 대한 서평논문이다.
평자의 논평은 다음과 같다. 첫째, 본서가 조선시대의 사법실천에서 감정의 역할을 본격적으로 논하기 시작한 첫 시도라는 점은 그 작업이 온당하였는가 하는 문제와 무관하게 높이 평가될 가치가 있다. 둘째, 본서의 저자는 플레이어들의 감정이 직접적으로 드러나는 사료들만을 수집하여 감정사를 구성하려는 시도를 하였다. 차후의 감정사 연구자들은 조선시대 사람들의 감정을 추론할 수 있는 간접증거들까지 수집하는 수고를 감수하여야 하고, 나아가 간접증거로 감정을 추출하는 기술도 연마하여야 한다. 셋째, 감정사는 별도의 새로운 필드(field)가 아니다. 종래의 역사학이 보지 않았거나 보려고 하지 않았던 영역을 발굴하여 종래의 역사를 보완하려는 새 방법론에 속한다. 따라서 감정사를 시도하는 작업은 종래의 역사학 방법론에 불만을 품고 새로운 역사학을 시도하는 작업이 아니다.
This paper is a book review on the book titled The emotions of justice: gender, status, and legal performance in Chosŏn Korea written by Kim, Jisoo M, which was published in 2015. My comments are as follows. First, the fact that this book is the first attempt to discuss the role of emotions in the judicial practice of the Joseon Dynasty in earnest deserves to be highly evaluated regardless of whether the work was reasonable or not. Second, the author of this book attempted to compose a history of emotions by collecting only the materials that directly reveal players’ emotions. Future history of emotions researchers has to go through the trouble of collecting even indirect evidence, and furthermore, they have to hone their skills in extracting emotions from indirect evidence. Third, envisioning the history of emotions should not be considered as a specialized field but as a means of integrating the category of emotions into social, cultural, and political history.
