북한인권 개선을 위한 주요 대상은 북한 내 주민들, 탈북자들, 해외노동자들, 그리고 국군포로(POW) 및 전시와 전후 납북·억류자들을 포함한다. 1990년대 말 ‘고난의 행군’ 이후 북한인권 이슈에 대한 세계적인 관심이 늘었고, 이에 따라 유엔이 주도하는 국제법적 해결방안을 모색하는 노력이 진행되어 왔다. 국제법을 통한 북한인권문제 접근은 인권 규범의 보편적 적용을 재확인하는 중요한 과정이며, 국제 인권법은 인권침해에 대한 법적 대응을 가능하게 한다. 2003년 이래 매년 유엔에서 채택되고 있는 북한인권 결의안은 북한인권 개선의 필요성에 대한 국제적 공감대를 보여주고 있다. 특히, 2014년 2월 유엔 북한인권조사위(COI)의 보고서는 김정은 등 북한 지도자들의 책임규명(accountability)을 명확히 하였고, 이들을 국제형사재판소(ICC)에 회부할 것을 권고하였다. 이는 북한인권문제에 대한 국제사회의 인식변화를 보여주는 중요한 모멘텀이었지만, 유엔 안보리 상임이사국인 중국과 러시아의 거부권 행사로 ICC 회부가 실패하였다는 점은 국제법의 한계를 보여준다. 그러나, 북한인권문제에 대한 국제법적 접근은 한국과 미국 등 자유 민주주의 동맹국을 포함한 ‘유사입장국들’이 도덕적으로 타당한 대응을 할 수 있게 하며, 북한의 추가적인 인권침해를 제한하는 예방적 효과를 제공한다. 결국, 이러한 방식은 문제의 심각성과 즉각적인 대처의 필요성을 강조하며, 보편적 인권의 확립에 대한 국제 개입 가능성을 제시함으로써 중요한 기여를 하고 있다.
한편, 전략적 시각에서 볼 때, 북한의 핵과 인권문제는 복잡하게 연결되어 있으나, 인권문제는 종종 부차적 이슈로 여겨져 왔다. 김정은 정권은 대외적으로 핵과 미사일 능력을 강화하며, 대내적으로는 주민 통제를 통한 일인 지배를 공고히 하는 데 주력하고 있다. 더욱이, 이 정권은 군사력 강화에 자원 대부분을 소비하여, 북한 주민들은 생계 곤란에 시달리고 있다. 인권 개선은 북한 정권에게 도전일 수 있지만, 동시에 새로운 기회가 될 수 있다는 점을 강조하는 것이 중요하다. 그러므로, 북한과의 신뢰할 수 있는, 종합적인 합의를 도출하기 위해서는, 인권문제를 글로벌 및 지역적 안보 논의의 ‘주류화’할 주제로 삼아야 한다. 이를 위해, 보편적 가치와 규범에 기반한 신중한 전략, 그리고 국제사회의 지속적인 압박과 협력이 필요하다. 한편, 한국은 리더십이나 정권교체와 무관하게 일관되고 원칙적인 방식으로 인권문제를 대북정책에 통합해야 한다.
이러한 맥락에서 본고는 북한인권문제의 주요 이슈들을 규명하고 분석하며, 이 이슈들이 국제법적 또는 전략적 관점에서 왜 중요한지를 강조한다. 또한, 북한인권문제의 시급성과 중요성에 비해 해결방안 모색이 어려운 이유, 그리고 이 문제에 대한 한국과 국제사회의 향후 과제를 논의하고자 한다.
Efforts to improve North Korean human rights mainly target the nation’s residents, defectors, overseas workers, and prisoners of war (POWs) during the Korean War, and abductees and detainees of both Korean and foreign nationalities. The ‘Arduous March’ in the late 1990s in North Korea stimulated a global interest surge in these issues, fostering UN-led initiatives for international legal solutions. Utilizing international law to address North Korean human rights violations reinforces the universal application of human rights norms, and offers a framework for responding legally to these infringements. Since 2003, annual UN resolutions on North Korean human rights underline the global consensus on the urgency of improvements. Notably, the February 2014 report of the UN Commission of Inquiry (COI) on North Korea delineated the accountability of North Korean leaders, including Kim Jong-un, recommending their referral to the International Criminal Court (ICC). Despite signifying a shift international perception of North Korean human rights, this referral’s failure due to the veto of China and Russia, both permanent members of the UN Security Council, showcased international law’s limitations. Yet, an international legal approach enables ‘like-minded countries,’ including liberal democratic allies such as South Korea and the United States, to morally justify their responses to North Korean human rights violations and serves as a deterrent to further transgression. By emphasizing the gravity and urgency of the issue, and the potential for international intervention, this approach significantly contributes to the promotion of universal human rights.
From a strategic perspective, the entwined complexities of North Korea’s nuclear and human rights issues often relegate the latter to secondary importance. The Kim Jong-un regime is externally invested in bolstering its nuclear and missile prowess while internally reinforcing its autocracy through population control. This focus has resulted in the majority of resources being allocated to military buildup, thereby exacerbating the hardship of North Korean ordinary people. It is critical to underscore that human rights improvements, while challenging, could also serve as potential opportunities for North Korea. Therefore, for a trustworthy, comprehensive agreement with North Korea to materialize, human rights must transition from a peripheral concern to a ‘mainstreaming’ topic within global and regional security dialogues. This shift necessitates a carefully crafted strategy ground in universal values and norms, coupled with continuous international pressure and collaboration. South Korea must also consistently integrate human rights considerations into its North Korean policy, irrespective of changes in leadership or characteristics of the political regime.
In this context, this paper delineates and dissects the primary North Korean human rights issues, underscoring their significance from both international legal and strategic perspectives. Despite the urgency and importance of these human rights issues, the paper discusses the inherent challenges in finding resolutions, and outlines prospective tasks for both South Korea and the international community in addressing this critical problem.
