디지털 전환은 우리 사회 전반과 인류의 삶에 중대한 변화를 일으킨다. 행정 영역에서도 지능정보기술을 활용하려는 시도가 활발하다. 행정에 지능정보기술을 활용할 경우, 급부행정에서의 사각지대를 개선하고 복지 수혜의 폭을 넓히기 위해 데이터를 활용한 적극 행정을 도모할 수 있다. 행정에서의 효율성과 정확성을 제고하여 행정서비스 품질 개선이 가능하며, 행정의 투명성과 통제 가능성을 증대시킬 수 있을 것이다.
행정법학의 관점에서는 행정 방식의 변화를 직시하고, 데이터 기반 행정이 가지는 장점을 인식하여 행정에서의 기술 이용의 편익을 극대화해야 할 뿐만 아니라, 예상되는 역기능을 방지하거나 최소화하기 위한 연구와 노력이 필요하다. 데이터 구축과 공유를 활성화하면서도 데이터 기반 적극행정에서 발생 가능한 각종 문제점에 대응할 수 있도록 하는 공법상의 연구가 이루어져야 할 것이다. 이를 위해 데이터 기반 행정의 의미와 범위를 고찰하고, 데이터 기반 행정이 구현되는 방식, 데이터 기반 행정에 대한 법적 규율 및 국내외에서의 경험을 고찰해야 한다. 데이터 기반 행정은 증거 기반 행정에서 출발했지만, 디지털 전환과 더불어 행정에서 데이터와 인공지능 분석 방법을 수용하여 자동화되고 적극적인 행정을 한다는 의미로 확장되었다. 데이터기반행정법 등을 통해서도 이러한 변화를 수용하고 있다. 행정에서의 데이터 사용으로 인해 예상되는 역기능을 살펴보고, 이를 제어할 수 있는 제도적 방안을 검토할 필요도 있다. 데이터 활용으로 인해 편향된 결과, 의도되지 않은 차별, 프라이버시 침해, 자기결정권 침해 등의 문제가 나타날 수 있다. 이를 통제하기 위해 알고리즘에 대한 사전영향평가 및 감사를 포함한 조치가 필요하고, 적절한 거버넌스를 구축해야 할 것이다. 데이터 기반 행정의 실질적인 구현을 가로막는 법적 요소에 대해서도 분석해야 할 것이다. 데이터의 수집, 관리 및 공유를 적정하게 관리해야 한다. 실질적으로 데이터 활용이 이루어질 수 있도록 거버넌스를 구축하고, 리스크를 줄이기 위한 법적 고려 역시 이루어져야 할 것이다.
데이터 기반 행정이라는 개념을 단순한 증거 기반 행정을 넘어서서 디지털 전환과 지능정보화에 적합한 개념으로 발전시키기 위해서는 기술의 효율적인 이용과 더불어 리스크의 제어라는 균형 있는 시각을 갖추어야 한다. 행정에서의 데이터와 지능정보기술 활용으로 인한 편향, 프라이버시 및 자기결정권 침해의 문제를 최소화하고, 기술이 주는 편익을 최대한 누릴 수 있도록 하기 위해서는 기술 활용을 통해 변화한 행정 작용에 대한 고찰과 더불어 정교한 제도의 설계가 필요하다. 데이터를 활용한 행정 작용이 이루어지는 과정이 과연 기존의 행정법 도그마틱의 틀 안에서도 제대로 작동할 것인가의 문제가 향후 행정법학의 과제일 것이다.

Proactive administration using data can be promoted to improve blind spots in benefit administration and expand the scope of welfare benefits. Administrative service quality can be improved by enhancing efficiency and accuracy in administration, and administrative transparency and controllability can be increased.
From the perspective of administrative law, changes in administrative methods should be faced and recognized the advantages of data-driven administration in order to maximize the benefits of technology use in administration. Furthermore, research and efforts are needed to prevent or minimize expected dysfunction. Research on public law should be conducted to enable data construction and sharing while responding to various problems that may arise in data-driven proactive administration. To this end, the meaning and scope of data-driven administration should be considered, the way data-driven administration is implemented, legal regulations on data-driven administration, and domestic and international experiences should be considered. Data-driven administration started with evidence-based administration. However, with digital transformation, it has expanded to mean that administration accepts data and artificial intelligence analysis methods and conducts automated and active administration. These changes are also accepted through the Data-driven Administration Act and etc.. It is also necessary to examine the expected adverse effects of data use in administration and review institutional measures to control them. As a result of data utilization, problems such as biased result, unintended discrimination, privacy infringement, and self-determination infringement may appear. To control this, measures including pre-impact assessment and audit of algorithms will be needed, and appropriate governance will need to be established. Legal factors that hinder the practical implementation of data-driven administration should also be analyzed. Data collection, management, and sharing should be properly managed. Governance should be established so that data can be utilized practically, and legal considerations should also be made to reduce risk.
In order to develop the concept of data-driven administration beyond simple evidence-based administration into a concept suitable for digital transformation and intelligent information, it is necessary to have a balanced view of risk control as well as efficient use of technology. In order to minimize the problem of bias, privacy, and infringement of self-determination rights caused by the use of data and intelligent information technology in the administration, it is necessary to consider the changed administrative actions and design sophisticated systems. The question of whether the process of administrative action using data will work without problems even within the framework of the existing administrative law dogmatic will be a task of administrative law in the future.
