대상판결은 배우자에 대한 증여가 배우자의 기여나 노력에 대한 보상 내지 평가, 실질적 공동재산의 청산, 배우자의 여생에 대한 부양의무의 이행 등으로 이루어진 것일 때에는 특별수익이 아니고 유류분반환의 대상이 되지 아니한다고 한다. 이 판례는 잘 확립되어 하급심 재판실무에서는 빈번하게 원용되고 있으나 그 이론적 근거와 적용 범위가 반드시 분명하지 아니한 점이 있다. 학설로는 이러한 판례를 기여분(민법 제1008조의2)과 관련지어 설명하거나 특별수익의 무상성을 문제 삼거나 배우자상속의 흠을 메우려는 시도로 해석하는 견해가 있다. 그러나 이 판결이 다루는 사안유형은 기여분과는 무관하며 배우자의 기여는 원칙적으로 무상이고 부부 일방의 배우자에 대한 증여를 전제하고 또 그 경우에만 적용된다는 점에서 직접적으로는 법정상속인 배우자상속과도 무관하다. 대상판결은 재산분할과의 균형을 고려하여 사전적 재산분할에 대하여 재산분할에 준하는 존속력을 가진다는 뜻으로 이해함이 옳다. 이것이 배우자상속에 연장될 여지가 있고, 그럴 필요도 있기는 하나, 대상판결이 직접 말한 바는 아니고 대상판결보다 더 나아간 것이기도 하다.
The Supreme Court of Korea rules that an inter vivo gift for one’s spouse shall not be subject to reserved heirship or the forced share of the estate when it was made as a compensation for or acknowledgment of the spouse’s contribution or endeavor during marriage, liquidation of de facto martial properties, or alimony for the surviving spouse. This ruling is well established and frequently applied in lower instance court practice, while the theoretical basis as well as the precise application are not clear. Legal literature opines that this ruling is related to augmentation of the share of the heir who has made a significant contribution to the deceased, according to article 1008-2 of Korea’s Civil Code, or that this kind of gift is not a gift in fact but a transaction for value; or that it purports to correct the deficiencies in the existing law of spouse’s heirship. The cases the ruling covers, however, relate to neither the augmentation of the share of the prospective heir nor spouse’s heirship. It applies only to the gift for the spouse in practice. All in all, the ruling implies that a transfer of property between a couple would stand and not be subject to reserved heirship or the forced share of the estate as far as it corresponds to a hypothetical equitable division of marital property so that it can be regarded as an anticipated and voluntary equitable division of marital property acquired during marriage, and as such it is agreeable. The similar correction or analogy might be necessary when one of the couple dies, while it is not, and goes beyond, what the ruling says.
