종래 한국의 민사법학은 법사학이나 법사학적 방법론에 좀처럼 관심을 기울이지 않았으나 2017전합 판결에 대한 평석에서 법사학적 논고들이나 법적 사료가 대량으로 활용되거나 인용되고 있다. 법사학적 논의가 생산적으로 진전되려면 ‘사료 구사의 논리적 엄밀성’도 구비되어야 한다는 생각에 이 논문에서 종래의 관습법 담론에 비판적 논평을 덧붙였다.
대부분의 민법학 논자들은 명시적·묵시적으로 현행 대법원판결과 조선고등법원판결이 연속되고 있다는 인식을 가지고 있다. 그러나 과연 그런 것인지 여부는 면밀한 검증이 필요하다.
이런 문제의식에서 Ⅱ에서는 조선고등법원판결이 전제하고 있는 관습·관습법·구관 개념과 2000년대 이후의 대법원판결이 전제하고 있는 관습·관습법 개념이 다르므로 현행 대법원판결과 조선고등법원판결이 연속되고 있다는 인식에 수정이 불가피함을 논증하였다.
Ⅲ에서는 《관습조사보고서》와 《민사관습회답휘집》의 내용에 상호모순되는 기술이 있음을 지적하고 이를 사료로 활용하는 종래의 민법학 논고들 논증의 취약성을 논증하였다.
Ⅳ에서는 《민사관습회답휘집 속편고》326호의 내용을 소개하고 그 논증의 비논리성을 논증하였다.
Ⅴ에서는 2017년전합 다수의견의 조선 후기의 임야지배관계에 관한 역사관을 논평하였다.
Ⅵ에서는 일제강점기의 회답·판결이 현대한국에도 계속 전승되고 학술적·대중적 지지를 받는 이유를 추정하였다. 아마도 그 결론이 변화된 근대사회에서 학술적·대중적 지지를 얻어내기에 유리한 모습을 띠고 있기 때문인 것처럼 보인다.
이 글은 일제강점기에 형성된 관습법 중 법정지상권 담론에 초점을 맞추어 비판적 논평을 가하였다. 결론에서는 일제강점기에 형성된 관습법 전체에 대하여 전면적이고도 심층적인 재검토가 필요함을 역설하였다.Conventionally, civil law studies in Korea seldom pay attention to legal historiography or methodology of legal history, but many review essays on the 2017 en banc Supreme Court judgment used or cited information about legal historiography. I would like to add a critical comment to the conventional legal discourse on the thesis of so called customary acquisition of gravesite superficies in this article, because I think that in order for the legal history discussion to proceed more productively, the “logical rigor of the use of the historical material” should be used.
Most civil law scholars explicitly or implicitly recognize that the current Supreme Court judgment of the year 2017 took over the Colonial Chosun High Court judgment. However, it is necessary to verify whether it is so or not.
To verify it, in part Ⅱ I examined the concept of customs, custom (customary law), and old custom which were presupposed by the Colonial Chosun High Court and the concept of those of the current Supreme Court of Korea. I concluded that both of the concept is quite different, so scholars should change conventional understanding.
In part Ⅲ, I pointed out the vulnerability of arguments in civil law papers that use the “Customs Survey Report of the colonial period(慣習調査報告書)” and “Civil Customs Response Collection (民事慣習回答彙集)” as historical sources.
In part Ⅳ, I introduced the contents of the sequel to Civil Customs Response Collection No. 326 and pointed out some illogical nature of the arguments.
In part Ⅴ, I commented the view of the current Supreme Court of Korea about the dominant property relations of the forestry in the late Joseon Dynasty.
In part Ⅵ, I guessed the reason why the answers and judgments of the Japanese colonial period continued to be passed down and received academic and public support. I guess that this is because the conclusion is advantageous in obtaining academic and public support in the changed modern society which seeks foremost land commercialization.
In this article, I made critical comments focusing on the conventional legal discourse of customary acquisition of gravesite superficies.
In conclusion, I emphasized the need for a full and in-depth review of the entire customary law formed during the Japanese colonial period.
