위장이혼에 따른 재산분할에 대하여 조세법상 어떻게 대응해야 할 것인지를 살펴보는 경우에 우선 위장이혼이 가장행위에 해당하는지 여부를 중요하게 고려하여야 한다. 만일 위장이혼이 가장행위로 판명되면 이혼의 법적 효력이 부인되고 재산분할은 혼인상태에서 배우자에게 재산을 무상 이전한 것으로 보게 되므로 이전된 재산 전체가 증여세 과세대상이 된다.
하지만 대상판결은 이혼 당사자의 형식적 이혼의사를 존중하는 입장에서 가장이혼을 쉽게 인정하지 아니하고 조세회피 목적의 위장이혼이라 하더라도 민법상 유효한 이혼이라고 보고 있다. 정당한 이혼의 경우에도 그로 인한 재산분할이 적정액을 넘어 과대하게 이루어진다면 재산분할 본래의 취지를 벗어나기 때문에 그 과대 부분은 사실상 재산의 무상 이전과 다르지 않게 된다. 따라서 이 경우 조세회피행위에 해당한다면 증여세 과세를 적극 검토할 수 있다. 그럼에도 정당한 이혼의 경우에는 과대한 재산분할을 상정하기 어렵다는 점에서 볼 때 재산분할로 인한 증여세 과세 문제가 발생하는 사안은 대부분 위장이혼의 경우라고 짐작할 수 있다.
위장이혼 및 재산분할에 대한 증여세 과세논리를 어떻게 구성할 것인가 하는 것은 두 가지 관점에서 살펴볼 수 있다. 하나는 상증세법상 완전포괄주의 증여 과세의 취지를 살려서 과대한 재산분할에 증여의 개념을 바로 적용하는 방법이다. 다른 하나는 과대한 재산분할을 조세회피행위로 인식하여 실질과세의 원칙을 적용함으로써 새로운 과세요건사실로 구성하여 과세하는 방법이다. 이 중 학설의 대립과 판례의 태도에 논란이 있는 실질과세의 원칙을 적용하는 것보다 완전포괄주의 증여 개념에 따라 증여세 과세가 가능하다고 보는 것이 합리적이고 법리적으로도 간결하다고 평가할 수 있다.
문제는 재산분할로 취득한 재산에 대한 증여세 과세 여부는 해당 재산분할액이 적정수준을 넘어 과대한지 여부에 달려있음에도 현재 이를 판단할 법적 기준이 설정되어 있지 아니하고, 재산분할의 복합적 성질에 비추어 일률적으로 객관화하기 곤란한 것이다. 이에 따라 구체적 사안에서 어떻게 적정 재산분할액을 평가하고 정당한 재산분할을 넘는 과대 부분을 증여세 과세대상으로 포착할지를 고민해야 하지만 기술적으로 쉽지 아니한 점이 있다. 이런 이유로 과세행정에서 위장이혼에 따른 재산분할에 대한 증여세 과세는 불가능에 가까운 어려움이 초래되고 있는 실정이다. 이를 근본적으로 해결하기 위해서는 해석론이 아니라 입법상 조치로서 재산분할액이 민법에 따른 정당한 범위를 넘는다고 인정되는 경우에 해당 이혼에 의하여 취득한 재산의 가액 중 과대부분은 증여에 의해 취득한 재산으로 본다는 증여의제 규정을 신설하여야 할 것으로 생각된다. 아니면 최소한 위장이혼에 따른 조세회피를 방지하기 위하여 이와 같은 취지의 선언적·상징적 명문규정 도입이 필요하다고 본다.In the case of property division due to false divorce, if you look at how to treat under the tax law, you should first assess whether the false divorce constitutes the sham transaction. The Supreme Court's ruling says a divorce is valid under civil law, even if it is for tax avoidance in respect of the divorce party's formal intention. However, even in the case of a legitimate divorce, if there is too much division of property due to divorce, the portion is different from the purpose of the division, which is equivalent to free transfer of property.
Nevertheless, the case of a legitimate divorce is hard to think of excessive wealth division. From this point of view, one can assume that most of the issues of taxation of gift taxes due to the division of property are cases of false divorce. How to construct the taxable logic of gift tax on false divorce and property division should be considered in two respects.
One is to directly apply the concept of giving to excessive wealth division of property by taking advantage of the purpose of comprehensive tax under the inheritance and gift tax law. The other is the method of taxing assets beyond the proper scope by applying the substance over form rule by recognizing them as tax avoidance.
Better, I think it is reasonable and legally concise to regard gift tax taxation as possible under the gift concept of comprehensive tax rather than applying the controversial substance over form rule.
However, whether the gift tax is imposed on the property acquired by the property division depends on whether the property division is appropriate, but there is no legal standard to measure it at present.
Therefore, it is not technically easy to evaluate the legitimate property division in specific case and to capture the part that exceeds the appropriate property division as the gift tax. For this reason, it is difficult to tax the gift tax on the property division due to the false divorce in the taxation administration.
In order to solve this fundamentally, it is necessary to establish the regulation that the excess of the amount of the property acquired by the divorce should be regarded as the property acquired by the gift in the inheritance tax and gift tax law if the amount of the property division is recognized as a legitimate range according to the civil law, not the interpretation theory. Or at least, it is necessary to introduce declarative and symbolic prestigious regulations to prevent tax avoidance due to false divorce.
