재판지에서 주어지는 재판의 효력이 외국에 미치기 위해서는 집행국에서 승인되고 집행가능하다는 선언을 받아야 한다. 수 개국에서 보호되는 특허에 관한 분쟁을 어떤 국가의 법원에 제소할 것인가를 선택함에 있어서는 다른 나라에서 승인되고 집행될 수 있는가의 여부에 의해 크게 영향을 받는다. 이는 대부분의 경우 패소자의 재산이 소재하는 곳의 법원에 승인과 집행이 신청되고, 재판국의 재판의 효력이 집행국의 영토로 확장되면 또 다시 동일한 당사자 사이에 동일한 소송이 다른 나라의 법원에서 제기되는 것을 방지시키는 효과가 있다는 점에 비추어 타당하다. 그런데 미합중국의 경우에는 재판이 50개 주에 걸쳐 즉시 집행가능하기 때문에, 미국의 특허권자는 연방 차원에서 자신의 특허권을 보장받는 반면에, 유럽연합 특허권자는 현행법상 개별 회원국가로부터 집행받아야 한다. 이는 유럽기업인들에게는 유럽연합 특허제도가 미국의 제도보다 경쟁적 열위에 있다는 것을 말해준다.
이른바 유럽특허패키지가 등장함에 따라 위와 같은 상황에 변화가 일어나고 있다. 단일특허 제도의 강점은 역내 전역에서 집행을 한꺼번에 할 수 있고, 특허통합법원의 장점은 단일한 절차를 통하여 범유럽 집행이 가능하다는 점에 있다. 그런데 단일특허 시스템이 구축된다고 하더라도, 특허출원인은 단일특허 대신 종래의 유럽특허를 선택할 수 있고 또 독일, 영국, 프랑스에 특허신청이 집중되고 있는 현실에 비추어 굳이 유럽연합 전역을 대상으로 하는 단일특허를 받을 필요성이 크다고 할 수 없기 때문에, 현행 시스템이 급격하게 바뀐다고 말하기는 어렵다. 이는 결국 양 제도 사이에 적지 않은 효과상의 차이가 존재한다는 것을 의미하는 것이기 때문에, 아래 논문은 양 제도에 내재되어 있는 위험과 대응방안을 특히 제3국의 입장에서 분석하고 제안하였다.A foreign judgment must be recognized or declared enforceable in the local forum in order to produce its typical effects as a judgment in the forum country. The choices as to whether to litigate disputes concerning these equivalent rights only in one jurisdiction, and in which particular jurisdiction, may be greatly influenced by the possibility to have a judgment from a prospective forum recognised and enforced in other countries. This is to be justified from two aspects. The one is that for the most part recognition and enforcement are usually sought in the forum where (judgment debtors’) assets are located. The other is that recognition of a foreign judgment prevents subsequent litigation in a different forum. Reliance on the res judicata effect of a foreign judgment is necessary to prevent the losing party from bringing new proceedings involving the same cause of action and between the same parties in the courts of another country. While in principle an American IP holder gets protection at the federal level, by means of judgments and orders which are immediately enforceable throughout the 50 States of the Union, to get a corresponding outcome his European counterpart has to work much harder.
This lack of enforceability entails for European business competitive disadvantage relative to their American peers. With European Patent Package this has been changing. The main advantages of unitary patents are their broad geographic coverage and the ability to enforce centrally, and the clearest benefit of the Unified Patent Court is the fact the it offers the possibility of Europe-wide enforcement in a single court action. Even when the unitary patent system is adopted, this situation for a long time seems to remain the same. If a patentee should assert an unitary patent, he is permitted to have the choice to ‘opt out’ from the Unified patent Court system by filing a request with the EPO. This implies that the two systems are different each other. In this regards I analyse the respective risks from them and strategies against them, especially from the Third State’s perspective.
