유럽민사소송법의 발전과정에서 강제집행법이 아킬레스건이었다. 적어도 브뤼셀협약이 1999년의 암스테르담조약을 거쳐 공동체규정으로 승격되기 전까지 유럽연합 내에서 강제집행은 속지주의적 원칙이 지배되고 있었다. 이를 극복하기 위해 유럽연합은 역내 간 사법협력을 당면과제로 설정하고, 여러 분야에서 단편적이나마 집행간이화 조치를 취하고 있다. 다툼 없는 채무에 대해서는 이른바 유럽집행권원 제도가 도입되었으며, 소액사건과 독촉절차 사건에서는 진정한 의미의 유럽집행권원을 탄생시켰다. 이에 힘입어 브뤼셀협약을 이어받은 브뤼셀규정이 최근 집행선언절차 폐지를 골격으로 한 대대적인 개정법을 시행하여 ‘차세대유럽민사소송법’이라고 평가를 받고 있을 뿐 아니라, 최근 입법된 유럽계좌압류규정은 유럽 전역에서 채무자의 금융기관 계좌를 가압류할 수 있게 함으로써 집행권원이 요구되지 아니하는 보전처분 영역을 획기적으로 발전시켰다. 국내 확정판결을 집행하기 위해 집행적격을 선언(집행문부여)하는 절차가 필요하듯이 외국재판을 집행함에 있어서도 집행선언이 필요하다.Mutual recognition and enforcement of judicial decisions across borders have developed over a ling time within the EU. As enforcement law reveals to be achilles heel of european civil procedure law, European legislature have made every effort to reform EU enforcement system, with the result of profound changes. This article reviews the many legal rules in EU on the enforcement of judgments in civil matters. It also summarizes current projects and new instruments that are presently making their way through the EU legislative process. Finally, the author comments on developments regarding important basics of the european law on enforcing judgments, with a special focus on the future of the exequatur decisions not only from EU member state but also from a member state of the future imaginative Asian economic community.
