우리나라에서는 중앙집권체제에 의해 초래된 수도권집중, 지방 불균형발전, 국가경쟁력 약화 등의 폐해를 치유할 목적으로 지방분권정책을 추진해왔다. 그러나 지방자치 실시 후 20여년이 지났으나 지방자치법의 중앙집권적 요소로 인해 지방분권의 현실과 법질서간의 괴리현상 등 많은 헌법적?법적 한계를 드러내고 있다. 본 연구의 목적은 현행 지방자치법을 검토?분석함으로써 자치권 제약의 문제점을 파악하여 향후 개정방향을 모색하는 것이다. 연구결과 수권 규범의 문제로서 헌법과 지방자치법의 한계와 지방자치법의 법령 체계상 지위문제, 지방자치법의 규정 체계상 문제가 나타났다. 따라서 지방자치의 권능을 강화시키기 위해 자치행정(조직)권, 자치입법권, 자치재정권을 강화하고 지방의회의 자율성을 제고하는 개정 방향을 제시하였다. 이로써 지방자치의 약화된 권능을 회복시켜 자율성을 바탕으로 한 지방자치의 고유 목적을 달성시키기 위한 제도적 개선에 대한 시사점을 의미 있게 볼 수 있을 것이다.The decentralization policy has been carried forward in Korea for the purpose of eliminating harmful effects caused by the centralized system such as concentration in the capital area, imbalanced development of regions, weakening of national competitiveness. However, the local self-government revealed various constitutional/legal limitations including the gap between the reality of decentralization and law and order due to the element of centralization in the Local Government Act despite the fact that 20 odd years have passed since the local self-government was first enforced. The purpose of this study is to seek a way to revise the current Local Government Act in the future by figuring out the problem of restrictions of autonomous right through review and analysis of the current Local Government Act. In the result of the study, limitations of the Constitution and the Local Government Act, the issue of status of the Local Government Act in the legislative system, the issue in terms of regulation system of the Local Government Act have emerged as issues of authorization standards. Therefore, a way of revision has been presented that reinforces the autonomous administrative (organizational) power, autonomous legislative power, autonomous financial power and boosts the autonomy of local assemblies in order to strengthen the authority of the local self-government. With this, the implications of institutional improvement will be possible to be regarded as meaningful, which aims to achieve the distinct objective of local self-government on the basis of the autonomy by restoring the weakened authority of local self-government.
