세계 최대의 원유/가스 부국인 이란은 원유매장량에서 사우디아라비아, 캐나다 다음으로 세계3위를 차지하고 있고(캐나다의 오일샌드 제외하면 세계 2위), 원유 수출에 있어서는 세계 4위를 차지하고 있다. 나아가 천연가스 매장량에서도 러시아에 이어 세계 2위를 차지하여 원유와 천연가스 매장량을 합산하였을 경우에는 세계 최대의 에너지자원 보유국이라고 할 수 있다.
그러나 세계 2-3위의 석유매장량에도 불구하고 이란은 석유정제기술의 부족과 생산량 감소 등으로 연간 소비량의 50% 이상을 수입하고 있는 실정이다. 1980년 이란혁명 전에는 일 6백만 배럴을 생산하였으나 2012년 현재 약 70%정도로 감소한 이유는 8년간의 이란-이라크 전쟁과 외국 투자사의 투자부진 그리고 미국의 경제제재 등으로 판단된다. 천연가스 부문은 2007년 기준으로 3.9조 입방피트의 생산량을 보이고 있는데, 원유생산량의 60% 이상이 수출되는 것과는 달리 천연가스 수출량은 거의 없다. 그 이유는 대부분 국내수요로 충당되기 때문이다.
이란에서 광물자원을 탐광하기 위해서는 광공업부가 발행한 탐광허가증을 취득한 후에만 수행될 수 있다. 허가증의 취득절차, 탐광기준, 허가증의 유효기간, 광업권의 양도, 그리고 기타 사항은 광업법에 정한 절차에 따라 마련된 시행령에 따라야 한다. 동 시행령은 상당히 복잡하면서, 엄격한 요건을 규정하고 있다.
이란의 광업법은 이란 헌법 제44조와 제45조와 그리고 국가의 광업권의 소유권을 광공업부(Ministry of Mines and Metals)에 부여한 신법 제2조에 따라 의회(Majlis)1998년 5월 16일 제정되었다. 이 법이 제정된 목적은 광업법의 흠결 제거, 광업 분야에서의 탐광 및 채굴의 확대, 천연자원의 개발 및 가공, 철강기업 등으로의 원활한 원료 공급, 외국산 원료 및 미완성 재료의 국내부품으로의 교체, 민관분야 참여를 위한 장벽 제거, 공공참여 보장을 위해 제정되었다.
광업법은 36개 조항과 네 개의 챕터로 구성되어 있고, 정의조항, 탐광 및 채굴 조항, 채광에 관한 일반조항 등을 수록하고 있다.Iran is OPEC’s second-largest oil producer and the fourth-largest crude oil exporter in the world. Iran has the world’s second-largest reserves of natural gas, after Russia.
The mining sector in Iran is regulated by the Mining Code of 1998. The law, comprising 36 articles and 4 chapters, provides a general description, definition, exploration, exploitation and general regulations concerning mining in the country. In order to eliminate defects and blank points and further expand exploration and exploitation in the mining sector, development and processing of minerals, supply raw material to factories, replace foreign raw material and half-manufactured goods with domestic ones, remove obstacles, establish facilities for participation of non-governmental mining works and ensure active public participation to rid the country of a single product economy, the government decided to formulate a new mining law and the necessary bill was submitted to the Islamic Consultative Assembly.
The special features of the new mining law are Guaranteeing proven mining reserves as acceptable security (Article 10, note 2); increasing the term of exploitation from 6 years to 35 years by offering priority to owners of exploitation licenses which possess official and negotiable instruments or title deeds (Article 10, Note 2); encouraging and supporting the Ministry of Mines and Metals in the extraction and processing of minerals for export and generation of value added (articles 16 and 17); organizing and making optimum use of services for mining experts and geologists (Article 27); eliminating regulations that impose unnecessary and overhead expenses for production of material in order to create stability in the calculation of the economics of production of mining products (Article 29); Establishing a capital investment fund for mining activities in order to compensate all or a part of financial losses incurred by exploiters and extractors of minerals; preventing the destruction and waste of mineral reserves (Article 34), etc.
