2011년 8월 30일 헌법재판소는 일본군‘위안부’와 원폭피해자들이 제기한 헌법소원심판 사건에 대해 이례적으로 위헌 결정을 내렸다. ‘1965년 체결된 한일청구권협정으로 피해자들의 보상청구권 소멸 여부에 대해 한일간 해석상 이견이 있음에도 불구하고 정부가 피해구제를 위해 분쟁을 해결하려는 조치를 취하지 않은 것은 위헌’이라는 판결이었다. 헌법재판소의 이번 판결은 일본에 대한 강제동원 피해자들의 배상청구권 문제에 대해 대한민국 정부가 외교적 노력을 적극적으로 해야 할 의무가 있음을 인정한 최초의 판결이었다.
피해자들이 헌법소원을 제기한 것은 한국정부가 2005년 한일회담 외교문서 공개 이후 한일회담 당시 일본군위안부 문제와 원폭피해자들에 대한 피해보상이 포함되어 있지 않았다는 점을 명확히 확인한 후였다. 30여 년 넘게 일본 사법부에 제기한 강제동원 피해자들의 소송은 1965년 체결된 「한일청구권협정」에서 ‘최종적으로 완전히 해결’되었다는 이유로 번번이 기각되었다.그러나 2005년 ‘한일수교회담문서공개’ 후 한국정부는 ‘한일청구권자금에 의한 1975년 정부 보상이 불충분하였다는 도의적 책임과 국민통합 차원에서 강제동원으로 인한 인적 피해·미불임금 피해 등에 대해서 추가적 구제조치를 강구’하고, 한일청구권협정 대상에 포함되지 않은 일본군‘위안부’와 원폭피해자, 사할린 동포 문제에 대해서 정부가 일본과의 외교협의를 통하여 지원조치를 확대할 것을 시사했다. 이들에 대한 보상문제가 한일청구권협정에서 논의조차 되지 않았다는 점이 명확해진 이상, 일본의 보상책임이 분명함에도 불구하고 정부차원의 대일교섭은 이루어지지 않았고 일본정부와 전범기업을 상대로 한 피 개인의 싸움은 그 후에도 계속되었다. ‘자국의 국민을 타국의 이익 침해로부터 보호할 국가의 의무를 다하라’는 헌법소원의 제기는 국가로부터도 보호받지 못하고 60여년을 외면당해 온 피해자들의 마지막 호소였다. 너무 늦었지만 자국민에 대한 피해보상에 대해 무관심했던 국가의 책임을 묻는 공식적인 판결이라는 점에서 이번 헌법재판소의 결정은 의미가 크다.
이번 판결로 다시 한 번 「한일청구권협정」의 한계와 함께 협정에서 다루어지지 않은 미청산 과제에 대한 해결 요구가 높아지고 있다. 그 가운데 원폭피해자 문제는 이미 1972년부터 대일 과거청산 소송을 통해 일본 사회에 제기되어 왔고, 나아가 재한원폭피해자를 지원해 온 한일시민운동을 통해 일본의 전쟁책임 문제까지 확장되어 왔다. 그러나 원폭피해자에 대한 연구는 그 수에 있어서 절대적으로 부족하고, 한국사회에서 이들의 문제가 왜 이렇게 지연되고, 외면되어 왔는지에 대한 접근은 이제부터 시작해야 할 단계라고 할 수 있다.
재한원폭피해자의 실태와 재판운동에 대한 대표적인 연구는 이치바 준코의 연구가 독보적이다. 1970년대 원폭피해자 실태조사를 기반으로 한 이우정의 연구보고서와 1990년대 한일미청산 과제로서 원폭문제에 주목한 이상화의 연구는 국내 연구성과로서 선구적이라고 할 수 있다. 최근에는 원폭피해자에 대한 구술자료집과 재판자료집을 통해 그들의 목소리를 생생하게 복원할 수 있게 되었다.
한일회담 문서 공개 이후, 「한일청구권협정」의 체결과정에 대한 상세한 분석과 함께 청구권협정 체결 이후 한일 양국의 대일민간청구권에 대한 보상 문제 해결이 어떻게 처리되었는지에 대한 관심은 더욱 높아지고 있다. 특히 청구권협정에 다루지 않은 미청산 과제를 한일국교정상화 이후 한일 양국이 어떻게 다루어왔는지에 대한 검토는 1990년대 이후 피해자들이 과거청산운동과 재판운동으로 전환하는 배경으로서 많은 시사점을 줄 수 있을 것이다.
본 논문에서는 최근 공개된 한국정부의 외교문서 「한국 원폭피해자 구호」(1968~1980)를 중심으로 재한원폭피해자 문제에 대한 한일 양국정부의 교섭태도와 인식을 검토하고자 한다. 이와 함께 원폭피해자와 한일시민운동의 연대가 한일 양국 정부의 교섭에 어떤 영향을 미쳤으며, 한일 양국의 법적·제도적 기반을 넓혀 왔는지 확인하고자 한다. 이 연구는 한일 과거사 미청산 문제에 대한 한국과 일본정부의 국가 책임을 분명히 할 수 있을 것이다.his study analyzes, based on the Korea's diplomatic literature entitled "Relief for Korean Victims of Atomic Bombs," the way the Korean and Japanese governments have perceived the issue of the Korean atomic bomb victims since the Treaty on Basic Relations between the Republic of Korea and Japan was signed in 1965, and negotiated for early settlement of the issue. Korean victims of atomic bombs have demanded compensation for damages and treatment of complaints arising from exposure to radioactivity of the atomic bomb to the Korean and Japanese governments, respectively. However, the Korean and Japanese governments have consistently been taking the stance that the issue had already been settled under "the null and void" clause. The brother and sister Sohn, Gwi-Dal and Sohn, Jin-Doo who unlawfully entered Japan as a stowaway and attempted to get medical treatment in Japan marked a milestone that brought home to the Japanese society the gravity of the situation the Korean atomic bomb victims had faced. At the same time, the lawsuit filed by Sohn, Jin-Doo paved the way for the reorganization of institutions that would make it possible to expand compensatory measures for the Korean atomic bomb victims on a national level.
The Korean government has maintained a negative stance at the issue, demanding support on a humanitarian level,since Agreement on the Settlement of Problem concerning Property and Claims and the Economic Cooperation between the Republic of Korea and Japan had already settled the issue of the Korean atomic bomb victims from the legal point of view under the premise that the issue of compensation should remain a domestic issue. Under such circumstances, the Korean government had pigeonholed the issue by keeping it out of the official agenda of diplomatic negotiations. That was because the Korean government worried that the economic cooperation program might shrink, seeing that the Japanese side indicated its intention to provide grant in aid in the form of Korea-Japan Economic Cooperation.
With Sohn, Jin-Doo winning the lawsuit in 1978 in the Supreme Court, the Korean government belatedly came up with a new cause whereby to claim for compensation for the Korean atomic bomb victims. The Korean government demanded Japan's support, indicating that 'in fact the issue had imperfectly been settled since the issue of atomic bomb victims 'was ruled out at the outset from the object to which the Treaty on Basic Relations between the Republic of korea and Japan, Agreement on the Settlement of Problem concerning Property and Claims and the Economic Cooperation between the Republic of Korea and Japan applies.' This marked a significant shift in perception where the limit to ' Treaty on Basic Relations between the Republic of korea and Japan, Agreement on the Settlement of Problem concerning Property and Claims and the Economic Cooperation between the Republic of Korea and Japan.' was admitted However, the Japanese side came up with a package deal including free medical consultations by Japanese doctors dispatched to Korea, free medical training for Korean doctors invited to Japan and treatment of Korean patients invited to Japan, on a humanitarian level, asserting that legal liability had been finalized. However, of the three proposed programs, 'treatment of patients invited to Japan' alone materialized on a minimum level, which did not require financial support separately.
