본고에서는 최근의 형벌법규의 제․개정의 중벌화경향이 범죄를 억제 내지 예방하여 시민의 안전을 지키는 유효한 수단이 될 수 있는가, 그리고 ‘범죄인의 재사회화’라는 형벌목적과 부합하는가의 당부를 이론적으로 검토하였다. 이들 내용들을 요약하면 다음과 같다. 첫째 사회복귀를 어렵게 하는 구금형의 장기화 경향은 사회의 적을 증가하게 하는 입법정책임을 인식하는 일이다. 형벌적 해악에 의한 위하 내지 범죄의 억지는 환상이며, 엄벌화의 중벌주의 입법의 대부분은 실제에 있어 범죄억지효력을 증명할 수 없는 상징입법으로 국민들의 불안감이나 보복감정에 부응하는 인기영합적인 소위 포퓰리즘 입법의 전형이다. 둘째 사회전반에 팽배한 신자유주의의 ‘형벌의존증후군’ 양상을 불식하는 일이다. 형벌이 사회문제해결의 만능수단의 역할을 해서는 아니 되며, 국민의 법 감정이나 정의 관념이란 모호한 개념에 영합한 중벌주의의 형법개정은 장래적으로 값비싼 대가를 지불해야 한다. 범죄자의 재사회화를 포기한 경직된 응보형론의 중형주의는 범죄억제에 도움을 주지 못함은 물론 종국에는 형벌에 대한 총체적 불신을 초래한다. 셋째 범죄인의 자립을 지원하는 연대적․포용적인 형법이론의 재정립이 요청되어진다. 이를 위해서는 전근대의 혼미와 포악을 극복한 근대형법원리를 재확인해 인간의 존엄에 부합하는 형사입법원칙을 확립하는 것이 필요하다. 행형목적에 있어 재사회화사상의 책무는 형사제재체계에 있어 포기할 수 없는 원칙으로 이는 자유형을 선고․집행해야 하는 경우조차도 자유박탈은 개방적 형식으로 재사회화를 지향해 친화성 있게 실시되어질 것을 요구한다.Crime, and the measures designed to control and reduce crime, provides a major challenge to national authorities within almost every country of the contemporary world. The shocking child rape cases revealed to the Korean public in recent years pushed the entire Korean society to discuss measures against sex crimes, especially those against children. And the existing punishment was largely criticized as being too lenient on the brutal child abuser. The National Assembly also passed last year a revision bill of the criminal law(Article 42 etc., Amended by Act No.10259, Apr.15, 2010) and five other sex crime-related laws(Act No.10257, 10258, Apr.15, 2010 etc.), all imposing stronger punishments on sex offenders, especially those who commit crimes against minors. According to the laws, the maximum jail sentence for a sex offender would be extended from 15 years to 30 years. Convicts would also have their personal information and faces revealed to the public and would not be granted the benefits of a statute of limitations. But there is little evidence, however, that severe punishments deter any better than more lenient ones. Criminal punishment is justified on several grounds. The major ones are retribution, deterrence, incapacitation, and rehabilitation. Retribution, deterrence, incapacitation, and rehabilitation have a long history, all having justified punishment for several centuries. But historically, they have not always had equal weight. For most of the twentieth century, rehabilitation was formally dominant. In the past ten years, retribution and incapacitation have had a strong resurgence. This study examines the legislative trends of the severe punishment principle in criminal law and explores several solutions to the problem. The study consists of four main parts. Ⅰ. Introduction, Ⅱ.
