Due to sticking to the traditional systems at enactment of Civil Law, there are lots of provisions in family law which are not modern and democratic. Many patriarchal systems, e.g. the family system, the relative system and the succession right of headship of family for paternal rights, etc., are typical cases. Therefore, it may be essential for our family law to be revised.
After the enactment of the Civil Law, our family law has been revised five times in 1962, 1977, 1990, 2002, 2005. Especially we have to take notice of the revision in 1990. When it put in force in 1990, it was a Copernican Revolution in our family system.
In 2005, family law was revised again. It also, the author thinks, was a Revolution. The Family system was finally abolished.
In this paper, the author described the history of the Korean family law in order to know our task which confront us now.
