Usually, the society of sovereign sates has described as the tern of anarch because there is no authority to order the state how to act. However, such a simplistic approach to the international society has never fit reality. Since the beginning of the modern international society, as it came to being with the Peace Treaties of Westphalia(1648), sovereign states never acted toward each other in an anarchic manner. Furthermore, International community is not really a community at all, but several intertangled communities with common interests. But these common interests emerged as a result of several worldwide events, such as First World War and the Great Depression. When we refer to the order of international society, we necessarily imply that this society is governed in th loose sense of the term. Thus, under this certain conditions, it is legitimate to refer to international governance. For international governance, common interests among states and priority setting are necessary.
To discuss this new issue in international legal dimension, this article review three point. First, this article examines the theoretical background of international governance. As a international norm, international law cannot help reflecting the change of international society. And now, to do so, international law should reflect the theoretical development of international relations theory which bust up the change of international society. Therefore, I have reviewed the theoretical background of international governance and prerequisites of international governance. Second, this article address the relations of international law and international governance. For the genuine international governance, the notion of sovereign equality should be realized in the relation between the actors of international governance. In the development process of international law, we can discover the trace of international governance such as European Concert of 19th century. Third, this article analyze the case of United Nations and World Trade Organization as a contemporary example of international governance. At the dimension of those international institutions, there is a rise of new actors in the process of governance, and there is a shift in the locus of governance to new arenas and existing rules in traditional governance arenas are changing. Finally, this article conclude the enlargement of international governance will contribute to the democratic development of international society and international peace.
