Migrant workers have always been an issue for any countries, unions and ASEAN is not the exception. However, ASEAN has been giving efforts on establishing an excellent regional instrument to protect towards this matter. In 2007, ASEAN has established a Declaration on the Protection and Promotion of the Rights of Migrant Workers. However, this Declaration does not cover the undocumented migrant workers which is still the maintained shortcoming.
In this work, it is designed to study and analyze the recent issues of women migrant sex workers in ASEAN countries. Moreover, for a better establishment of the legal instrument of ASEAN, I would also like to raise the proposal for the necessity of ASEAN Migrant Workers' Rights Instrument and do an analysis for ASEAN Member state based on the International Standards and some other Good Practices to ensure the quality of human rights protection, especially for women migrant sex workers in ASEAN Regions. The content of this dissertation is clearly divided into five main Chapters.
In Chapter I, I would begin with the Introduction, in which I would include the relevant issues that are the main content of this paper. Additionally, this chapter will illustrate a numerous amount of migrant workers in ASEAN and the dominant of women migrant workers recently in the region. Last but not least, this part will show the methodology that is used to conduct this research.
In Chapter II, I would give a view of current issues of women migrant sex workers in ASEAN. In detail, this part will first show the general concept on women migrant worker, sex worker and the definition. At the same time, it will also show how big the size of sex industry within Asia countries and emphasize how these women are abused and their rights are violated. In addition, this part will discuss the conflicts between the Receiving Countries and the Sending Countries in ASEAN.
In Chapter III, I would conclude legal protection of migrant workers under international and regional level. From there, I would show that women migrant workers are also covered by these frameworks. I will base on some laws, frameworks that directly protect human rights, deal with international labour standard and specificly protect rights of women. Under regional level, the chapter will also conclude some frameworks that eliminate the discrimination regarding to migrant workers.
In Chapter IV, I would analyze Prostitution Reform Act (PRA) in New Zealand where sex work is decriminalized and elaborate the ASEAN Declaration on Protection and Promotion of the Rights of Migrant Workers. This part will go details on how sex workers are protected in New Zealand and the limits remaining under the PRA. Based on that, I will give recommendations for my next chapter. Besides, I will show how useful the ASEAN Declaration is for the new Instrument and what can be learned from the Declaration.
Chapter V will be focused on how to establish a new Instrument in ASEAN that could protect not only migrant workers but also women migrant sex workers. I will give my proposals for both domestic laws in ASEAN countries and propose a better protection law standard for regional level in responding to the issues of women migrant sex workers.
Finally, Chapter VI will conclude my research paper. This part will sum up all content of my work and also comes along with the final solution for my studied issues regarding women migrant sex workers in ASEAN region as well as the proposals for future legal framework on protecting their rights.
