When the dispute arises between two states, state often seek for the use of forces rather than seek for peaceful means. In the modern times, the armed conflict is having seen to be one of the most serious issues that international community concern about. As the technology is developed from time to time, the use of weapons as a means of warfare is significantly increasing by state actors and non-state actors during the armed conflict. Namely, the cluster munitions are one of the most dangerous weapons that could kill and maim people. The use of cluster bombs produces such tragedy, outcry, and thousands of civilians are the victims of those weapons. Such uses violate international law and shall be held criminal responsibility under international law. Nevertheless, one concerns that the continuity of the use of cluster bombs without criminal responsibility, there will be more than thousands of civilians will be the victims of weapons. This is the point where the dissertation will address the issues, key response to the issues and the proposal to the issues. Giving the depth analysis on the issue of criminal responsibility, the dissertation will be divided into six chapters. The Chapter One will be a brief introduction to the use of cluster bombs as means of warfare together with scope and limitation as well as research methodology. The Chapter Two will provide the history of cluster bombs use since before WWII to date, which classifies into three important events. Along with that, the international legal frameworks will be provided to support the analysis in the Chapter Four. The factual development in Syria and Yemen will be addressed in the Chapter Three. Moreover, the key responses from the international community, especially, U.N.; EU; and League of Arab States, will also be brought in the Chapter Three. The Chapter Four is the most essential chapter where it will give legal analysis on the criminal responsibility on the cluster bombs in Syria and Yemen. The interpretation will be based on Rome Statute and to pinpoint the four core crimes. When the problem cannot be solved, it requires the solution as the recommendation to the problems. Hence, the important proposal and approach will be provided in the Chapter Five. Last but not least, the Chapter Six will cover the summary of all the Chapters.
